OSHA News for
January 2019
What a month. It
saw some record cold temperature. My water pipes froze so will have the plumber
fix a leak. Every day was training as many want to get their team trained
before the spring. I trained 436 in the months. I was glad to train General
Dynamics in CT, UTX in Rockford and IMI in University Park. All are leaders in
their sector with DART and Incident rates before the average. They are not
perfect, but they work hard on prevention and training.
The OSHA page is
late with citations so there are many at the end of the newsletter this month.
This month’s ppt
is the 2017 BLS data. There are many good statistics this year. WE should not
be setting fatality highs but we are.
At the start of
this New Year, the Construction Safety Council is pleased to announce that
registration is now open for the 2019 CONSTRUCTION EXPO & SAFETY CONFERENCE
on March 4-5 at the Drury Lane Conference Center in Oakbrook Terrace.

OSHA News.
1) Larry Campion passed away in January. Larry
was at the Milwaukee office and the OSHA Training Institute.
2) #OSHA
penalties will be up by 2.5% in 2019. Serious violation will max at $13,260.
Willful and Repeat violations at $132,598. New amounts will take effect once
published in the Federal Register, which is currently on shutdown.
3) REMINDER: Feb.
1st Deadline to Prepare, Certify, & Post OSHA 300A Annual Summaries of Work
Related Injuries. Submit the electronic 300A by Feb. 2.
4) Indiana OSHA
may get $100,000 penalty for a worker fatality.
The bill (H.B.
1341), introduced Jan. 7, would increase fines to $100,000 from $7,000 for each
worker death resulting from an employer violating safety regulations. It also
would remove the ability for employers to negotiate a reduced penalty issued by
the Indiana Occupational Safety and Health Administration after such incidents.

OSHA standards starting on February 1, 2019.
7) MIOSHA OSHA
lowers blood lead. Former MIOSHA rules
allowed workers to have BLLs of 50 - 60 µg/dL before they had to be removed
from lead exposure. Under the former rules, they could return to work when
their BLL was below 40 µg/dL. The new MIOSHA rules require that employees be
removed from lead exposure when their BLL reaches 30 µg/dL and may not return
to work involving lead exposure until their BLL is below 15 µg/dL. The average
BLL in the general population is 1.12 µg/dL.

Energy (U.S.A.) Inc. (Docket No. 13-0900), a unanimous Commission vacated a
citation issued to a controlling employer for its alleged failure to ensure

Stories.
1) Luke Park,
owner of the Park Family Farm in Cortland County, was sentenced on Thursday for
child labor violations that resulted in the death of a 14 year-old boy in July
2015.
Park was sentenced
today to 60 days in jail, three years of probation and was ordered to pay
restitution in the amount of $10,500 for his convictions ofendangering the
welfare of a child, employment of a minor, and failure to pay a contribution to
the unemployment insurance fund.
The Attorney
General had originally indicted Park in November of 2016 after the July 2015
incident.
Park admitted
that Alex Smith, 14, was killed while working on the dairy farm.
Smith was
operating a hydraulic fork-lift, a violation of child labor laws, moving bales
of hay.
Park admitted
that he found the boy's body underneath the lift and a bale of hay with the
machine still running.
