OSHA News for September 2024 Hello, Where did the time go? September flew by fast with work every day. I am going to slow October down the first week to get caught up. This month's PowerPoint is construction scaffold safety. I have not sent one out since 2014. Mobile Scaffold are flipping when the worker reaches over the guardrails. This change by many manufacturers is a big change restricting the use. Aerial lifts are recommended. OSHA is citing the self closing gate on ladder openings. I will be teaching the 502 class in October. I will give you 30" ppts in order to teach the OSHA 30 hour class. Bring your laptop. You get to choose the topic. I don’t think anyone is doing this in the country. Some Manufacturers of LPG cylinders require gloves and Goggles when changing the forklift cylinder. Some say safety glasses and a face shield. These are placed on the inside rim of the cylinder. Today, the cylinder said gloves and goggles. What do you require? What does your SDS require? I've been looking all summer for the best ansi-rated impact gloves. I've narrowed it down to three outstanding gloves. Overall confort is the Hex Armor Chrome glove. Excellent comfort and fit. Lighter glove is GGs CIA NFT glove. This glove is much thinner but with excellent impact protection. For the cold is a winter glove by Ogre 773 CR + ice. It is warm and has great excellent protection. Over a dozen gloves did not make the cut. They were either uncomfortable and hot or just something I would not feel good wearing because of the tight fit in the knuckles or fingers. I want to say thank you to Dave Hood, dhood@emergentsafety.com, for putting up with me and helping me find the best ANSI impact-rated gloves. One company had 35 impact injuries due to handling material, and the reinforced gloves helped reduce it to 7. Another company had four impact injuries while handling wood. We got it to zero for the last three years using padded gloves and training before the ANSI standard came up with ratings. I really work on these impact injuries, look at the total number of hand injuries, and see what we can do to lower the number of incidents in larger companies. All three gloves are much better than the ones we used two years ago. I always keep a pair of regular Superior gloves for work, and I have a pair of impact gloves with me at all times and on construction sites if I have to handle any material. 15 people passed the BCSP tests this month. The scaffold fell into a floor hole. The floor was not covered per 1926.501(b)(4). The worker will not work again. $30 to do this right. Millions of dollars in legal fees, disability, and medical. This is multi-employer and the jury will decide which of the 6 entities is responsible. The BCSP Study group on Facebook has now 7000 people. It seems 5 are passing every week. The New Hierarchy of Control is 5 questions and missing those might the difference of passing and failing. This month's PowerPoint is hierarchy of control period I added the ANSI Z10 six element hierarchy control which is a big change for the certification test period but everybody else should know about it because we've had this for 50 plus years and now it's changed. OSHA News for July 2024 Hello, I took a vacation for a week and relaxed. When I came, I picked more legal cases and more audits. 15 people I know passed the certification tests this month. That is a record. The American National Standard Institute/International Society of Equipment and Safety Engineers (ANSI/ISEA) 138 standard rates impact-resistant gloves on a scale of 1–3, with 1 being the lowest level of protection and 3 being the highest: Level 1 Allows an average of 9 kilonewtons (kN) or less of force through the glove, offering limited impact resistance. Level 2 Allows an average of 6.5 kN or less of force through the glove, offering mid-level impact resistance. I like level 2 impact because it protects the knuckles. Level 3 Allows an average of 4 kN or less of force through the glove, offering high impact resistance. OSHA News for June 2024 Hello, We survived the heat dome. It was 12 days in the 90’s here. It looks like many got hydrated and took breaks to combat the heat. Fans work wonders. I did 11 site audits this month. Many companies want to see how they are doing for safety. The best sites have full time safety professionals with OSHA 510/511 and some certification. This month ppt is fatigue management. I see many making mistakes when tired or getting not enough sleep. The Trench injury case probably settled for seven figures. The defense hired the most expensive and best safety defense expert witness in the USA, who is $5000+ retainer and ~$400/hour. I saw our chances of winning 95%+. If in a jury trial, I figured the plaintiff would get $20-30 million. Big cities, big awards. Keys to the multi-employer case. - My nice Plaintiff attorney caught the president in a big lie under oath. - The Fire department had case-winning photos. (hint OSHA) - No documentation of training with no sign-in sheets. Gary Anderson, former Area Director of Chicago South and North passed away in June. I cannot find any information. OSHA ANNOUNCES SUSAN HARWOOD TRAINING GRANT PROGRAM FOR FY2024 On June 26, 2024, the Occupational Safety and Health Administration announced in the Federal Register the availability of funds and funding opportunities for the Susan Harwood Grant Training Program. There are three separate funding opportunities/announcements that are available: specifically (1) targeted topic training grants, (2) training and education material development grants, and (3) new capacity building grants. Hazard alert. Freezers and coolers are not a standard in OSHA, but OSHA has used the 5a1 in several of the deaths where the plunger does not work in case the latch breaks or will not work. Osha is citing these under confined space also. I've had two deaths in the last 5 years with them and there's another one in Rosemont with a guest that got trapped in a cooler. Freezers that have a pull cord have to have specific training because workers will not know to pull a cord in lieu of a plunger. I have not seen a food company in the last 5 years have all their freezers and coolers in compliance. I can make a case for OSHA to look hard for this hazard in the food industry. 5. The NFPA 660 for combustible dust standard is coming out in 2025. I have already started training on it. This is the most challenging subject for clients so far since it merged several PSM elements into the document. (PSSR, MOC, operating procedures, incident investigation, periodic audits, employee involvement, contractors, hot works) . OSHA News for May 2024 Hello, I got to go to five trench jobsites in May. Most are doing good or are learning. I expect more OSHA presence this year. OSHA did not get a cost of living so hiring is slowed. From the appropiations act. “For construction inspections, upon arrival at a worksite to conduct any programmed safety inspection, the compliance officer should determine whether the appropriations rider exempts a particular contractor. Any exempt contractor shall not be inspected. However, CSHOs shall proceed to inspect other non-exempt contractors on the worksite.” This affects the small trenching contractors and the roofers the most. OSHA can handle and inspect imminent danger, fatalities and formal complaints. For 10 of less employees, they can just advise on program inspections. See #1 for the link. What are some of the key changes in the update to the HCS and how do they align with international trading partners and other U.S. agencies? Most of the key changes in this update fall under one of the following themes: 1. Maintaining alignment with the GHS (primarily Rev. 7) and U.S. trading partners (including Health Canada’s WHMIS) Paragraph (f)(12) – small packages. Updates include special labelling provisions for 3 ml and 100 ml containers similar to Health Canada’s WHMIS requirements. Paragraph (i) – trade secrets. Updates include mandatory use of prescribed concentration ranges when exact percentages or percentage ranges of materials are claimed as a trade secret. The prescribed concentration ranges align with those used by Health Canada’s WHMIS. Appendix A (health hazards) updates align primarily with revised health hazard definitions and general updates to hazard classes in GHS Rev. 7. Updates include, but are not limited to, the Skin corrosion/irritation and Serious eye damage/eye irritation chapters, with non-animal test methods from Rev. 8 added to skin corrosion/irritation to promote use of alternative methods. Appendix B (physical hazards) updates align primarily with Rev. 7 and include, but are not limited to, Flammable gases (expanding hazard categories), Desensitized explosives, and Aerosols (including additional hazard category). Appendix C (label elements) updates align primarily with Rev. 7 and include new or updated hazards, updated guidance, and precautionary statements. Appendix D (SDS) updates align primarily with Rev. 7 and include revisions to SDS Sections 2, 3, 9, and 11. 2. Addressing issues identified during implementation of the 2012 update to the HCS Paragraph (d)(1) – hazard classification. The final rule clarifies which hazards must be evaluated and the hazard information required on the label versus the SDS. Paragraph (f)(11) – labels. The final rule adds flexibility for label updates on packages that have been released for shipment. Paragraph (f)(12) – labels. The final rule clarifies labeling requirements for small packages. 3. Improving alignment/coordination with other U.S. agencies Paragraph (f)(5) – bulk shipment. The final rule provides increased coordination with DOT. Paragraph (c) released for shipment definition – The final rule aligns with EPA. 3. The six foot rule from the edge does not exist anymore. However, as the Secretary point out in his brief, OSHA considered and rejected this approach in the Preamble to the Final Rule for fall protection. “In conclusion, after careful and complete consideration of the entire record, OSHA has determined that there is no ‘safe’ distance from an unprotected side or edge that would render fall protection unnecessary.” Safety Standards for Fall Protection in the Construction Industry, 59 Fed. The changes include the creation of a new OSHA regional office in Birmingham, Alabama, overseeing agency operations in the state, and those in Arkansas, Kentucky, Louisiana, Mississippi and Tennessee as well as the Florida Panhandle. The Birmingham Region will address the area’s growing worker population and the hazardous work done by people employed in food processing, construction, heavy manufacturing and chemical processing. OSHA is also planning to merge Regions 9 and 10 into a new San Francisco Region to improve operations and reduce operating costs. As part of the changes, the agency will also rename its regions to associate them by geography, rather than its current practice of assigning numbers to regions. As such, the area OSHA calls Region 4 will be renamed the Atlanta Region with jurisdiction over Florida, excluding the Panhandle; Georgia, North Carolina and South Carolina. The current Region 6 will be renamed the Dallas Region and have jurisdiction over workplace safety issues in New Mexico, Oklahoma and Texas 5. OSHA News for April 2024 Hello, Four months in and I have trained 1300 people. OSHA is present and I get calls wanting OSHA assistance. Usually, I refer them to people I know based on location. I am booked solid to the end of June. Giving an employee a safety handbook is not going to work if you expect them to read it. The testimony seems to be that the worker put in the truck or lost it. Weekly toolbox talks should be done and Monthly manager training. Several legal cases with the same surface falls. A walk around the workplace catch many of these hazards.
