industry. I used this in my OSHA 10 hour classes. I find it could go 2
hours if needed. I was thinking I put this out, but I could not find a

The new reporting rule that requires employers to call in amputations
is revealing how inadequate guarding and lockout is at many
facilities.


I have to renew my construction OSHA Train the Trainer so will have a
relaxing OSHA 502 April 21-23 at the Construction Safety Council.

evaluations for respirators. It is initially for this and not
annually.

3) I am seeing a rash of fall lanyards with severe corrosion. From the
manufacturer’s inspection guidelines: "Snaps: Inspect closely for hook
and eye distortions, cracks, corrosion, or pitted surfaces."

4) 55 gallon drums have zero rating to lift parts once holes are cut
into the sides. Four drums found in 2015 already from site audits.

6) OSHA penalty structure is not correct in the Field Operation Manual
because they put out an interim guidance. For example the FOM gives a
Medium Lesser $2000 in Table 6-2.

8) Good question on propane storage
What restrictions apply to the storage of propane cylinders in buildings?

The storage of propane in buildings is limited: Buildings frequented
by the public are limited to cylinders with a propane capacity of 1
pound. The total quantity stored is limited to 200 pounds of propane.
Buildings not frequented by the public are limited to a maximum
quantity of 300 pounds of propane. The cylinder size is not
restricted.

9) The deaths in mines were 260 in 1970. Last year it was 16. The
fatality rate also dropped 90% from 200 dead/100,000 miners to 20/100k

• Lessard didn’t return multiple calls seeking comment.

• The motion for contempt stems from a December 2010
Occupational Safety and Health Administration inspection that resulted
in citations for alleged “egregious, willful, serious and repeat
violations” for a lack of fall protection and other hazards.

March was the most training ever for me with four Saturdays and Three
Sundays doing training. I am up to 848 people trained in 2015. April
is off site training and four audits so it will be much less.

5) OSHA Hospitalization, Amputations Reporting triggers
Inspection Triggers. OSHA nonpublished memo said these reports by
companies to OSHA automatically trigger an inspection—
Category 1 reports— any of these trigger an inspection:
- a fatality;
- at least two hospitalizations;
- any injury of a worker 17 years old or younger;
- similar events at the worksite involving multiple injures that
occurred in the past year;
- employer history of repeat, willful, failure-to-abate or egregious violations;
- employer previously designated as a severe violator;
- employer covered by national or local emphasis program; or
- any imminent danger
Answer ‘Yes,’ Get Inspected.

Reports that could trigger an inspection if at least TWO of the
following questions below are answered ‘‘yes’’ will be recorded as
Category 2 reports,
The Category 2 questions are:
- Were temporary workers or ‘‘other vulnerable populations’’ injured
or made ill?
- Does the employer participate in a cooperative safety program such
as the Voluntary Protection Program or an alliance?
- Are employees still exposed to factors underlying the hazards
producing the injury or illness?
- Was the incident the result of failure of a safety program such as
lockout/tagout or process safety management?
- Were employees exposed to a serious hazard such as falls,
combustible dust or heat?
- Is there a pending whistle-blower complaint or inspection?
- Does the employer have a history of OSHA inspections?
- Did another government agency make a referral?
- Were health issues such as chemical exposure and heat stress involved?
If the answers to the Category 2 questions are ‘‘no,’’ then an
inspection may not be warranted

6) Update to the Neri Criminal trench jail. He was released from jail
December 24 after serving three weeks.
• Neri was permanently enjoined from engaging in trenching,
excavation, construction or related activities and permanently
prohibited from possessing or leasing any construction excavation
equipment.
• The judges also found that Neri, based on a review of his
tax returns and other financial records, was unable to pay the
$110,440 fine.
• However, the judges said the government ‘‘may continue to
pursue collection through an appropriate tribunal

7) Congrats to Julie Evans for her well-earned retirement. I worked
with Julie on and off since she started. She was a tireless hard
working person and was a great team leader.

8) Congrats to Sherrill Benjamin for his hard working whistleblower
manager career. He was an attorney and taught me nearly everything I
know on discrimination and whistleblower. I did several audits with
him and he was always a hardworking man.

9) Congrats to Dana Root on her retirement. Dana Root was the first
ergonomist I had a chance to work with extensively. She had the
patience to show me all the tools needed to conduct an ergonomic
evaluation.

10) Congrats to Nancy Nash for her promotion to the Regional Office in
Enforcement programs.

11) I audited 12 large construction company respirator programs. Three
issues were common. Lack of Medical Evaluation initially, No Annual
Respirator Training, and No quantitative or qualitative respirator fit
test. Most used did not know how to do a filtering face piece user
seal check.

12) I looked at 10 companies’ body harnesses and energy absorbers.
80+% had harnesses over five years old with some 17 years olds. About
50% of the snaphooks and carabiners did not have the gate strength
stamped on the gate. It should be 3600 pounds or higher.

for construction and general industry. I want to thank the OSHA people

For 2015, I want to concentrate on trenching safety for construction,
tree trimming safety for service sector, and lockout for general
industry. I see these as common problems for years and want to make a
ppt that shows more how to do it right. I will be glad to come out
free and take a look at your company and give you a verbal assessment
how good your company’s program is and how it compares to the hundreds
that I have seen.

Of course, if one takes into consideration upcoming federal salary
increases and inflation, OSHA actually has less to spend than last
year.

Changes from FY14:

• Federal enforcement received a $215,000 increase in FY15

• Whistleblower protection received a $500,000 increase in FY15

• State Programs received a $950,000 increase in FY15

• Federal compliance assistance took a hit - $1 million less for FY15

When Congress approved OSHA funding for FY15, the bill had several
riders on it that may impose some potential problems for the agency.

The riders:

• Require OSHA to notify the House and Senate committees of any new national,

regional or local emphasis programs as well as the data used to determine the

new program.

• Require the agency to consider all new currently available technology as the

agency moves forward with the silica rule

 13) My Informal poll about the new reporting rule revealed three
issues. OSHA gets about 350 calls a week. Many have safety systems and
trained people that call. What is not occurring as much is calls from
small employers and temp employers. They are also seeing people call
in when not sure which creates another problem, how is this handled? 

14) BLS has more details of deaths at work for 2012. For example, 30

6) Jake Frisella, a 21-year-old machine operator, was fatally crushed at Ventra Belvidere LLC while reaching into a machine to align parts made for Chrysler vehicles on June 10, 2014.

8) Former Asbestos Removal Trainer Pleads Guilty to Falsifying Hundreds of Certifications

Lachele Rene Thrower, who worked for an approved asbestos removal training provider, with willfully making materially false statements to the Environmental Protection Agency over the course of four years. Thrower admitted to falsely certifying between 100 and 150 workers from May 2010 to August 2014 

Thrower could face up to five years in prison and a fine of more than $250,000.

9) New Osha reporting requirements take effect January 1, 2015. Dr. Michaels noted that when employers call in to report a reportable event (fatality, amputation, in-patient hospitalization, or eye-loss) that OSHA will engage in a conversation with the employer. According to Dr. Michaels this is a new approach for the agency, however, he claimed that the agency’s objective is to help employers. When OSHA is notified of a reportable event the agency will inquire as to how the event occurred and what type of investigation the employer is or will do to determine the cause. Additionally, Dr. Michaels stated that OSHA will have a new website up by January 1st which will allow employers to report online.

10) Former Peoria OSHA discrimination investigator Jim Lucera passed away at the age of 70 in Pekin on December 4, 2014. Jim was always a nice guy to be around and loved the Peoria area.

11) OSHA’s Dr. Michaels “OSHA is exploring a variety of other actions to improve the safety of chemical facilities. These include considering changes to our emergency response standards, considering regulatory changes to improve ammonium nitrate safety, and modernizing and updating the PSM standard and policies, as well as developing targeted outreach and guidance products as appropriate.”

12) Historic fine for retaliation. Metro-North Commuter Railroad Co. In fining the railroad $260,000 plus legal fees, the U.S. Department of Labor said it found a culture of intimidation, in which supervisors actively tried to discourage workers from filing injury reports and punished workers who did.

November 2014 OSHA News

This month’s draft powerpoint is the OSHA’s new rule on reporting that

takes effect January 1, 2015. I was fortunate to give a speech to the
IL-IA Building trades and had a great interactive session. This is one

Here is the news for November 2014

1) A U.S. Marshall has taken an Illinois business owner into custody
after the employer failed to correct serious trenching hazards and pay
OSHA penalties. On Oct. 27, the Seventh Circuit Court of Appeals
granted a motion filed by Secretary of Labor Thomas E. Perez against
the owner of Mike Neri Sewer & Water Contractor Inc., based in Elk
Grove Village, Ill. This action followed the owner's long history of
failing to comply with OSHA standards and orders of the independent
Occupational Safety and Health Review Commission. (from DOL

In October 2013, the Court issued an enforcement order against Neri
and when he failed to comply, the Court held Neri in contempt in July
2014 and threatened him with possible incarceration. Last week, after
receiving no response from Neri, the Court granted the Secretary's
motion to proceed with coercive actions, ordering the U.S. Marshal to
place Neri in the custody of the Attorney General. Neri will remain in
custody until a District or Magistrate Judge certifies to the Court
that he has either fully complied with the Court's enforcement order
or has demonstrated he is unable to comply. (FROM DOL November 3,

10) Martin Romano of Victor MT, pleaded guilty Tuesday to federal
misdemeanor violations during a hearing before U.S. Magistrate Judge
Jeremiah Lynch in Missoula. One count of causing the death of a worker
by violating a safety standard. In addition, the company, “Mr. Asphalt
Inc”. of Corvallis MT, entered a guilty plea to the same violation of
29 U.S.C. 666(e), Violation of Safety Standard Causing Death of an
Employee.

Romano and his company were charged after 54-year-old William Irby Jr.
or Corvallis slipped off an oil tank while taking measurements and
fell 15 feet, hitting his head on a concrete pad.
