OSHA News for January 2023 Hello, It was another busy month with training and weekends of work. I passed the Safety Trained Suspervisor Construction examination in January. It is a BCSP test that is growing in popularity for site safety people. It is more of an OSHA construction test, and that is what sites should have. No math, risk management, and system safety. This month's ppt is Most Frequently cited standards for General Industry. I want to thank OSHA for the information. Lockout, Respirators, Hazcom, and Machine Guarding are dominating the top 10. 11413 fatalities with the title Stuck By from 2002 to 2022. #2 cause of worker death after falls. This is an area that can be improved. Specifically, OSHA cited the company for violations of the general duty clause in the Occupational Safety and Health Act 7) OSHA's maximum penalties for serious and other-than-serious violations will increase from $14,502 per violation to $15,625 per violation. The maximum penalty for willful or repeated violations will increase from $145,027 per violation to $156,259 per violation. 8) OSHA Revives Union-, Worker-Friendly Inspection Rep Rule OSHA is reviving a defunct enforcement policy by proposing a rule that would allow worker advocates to take part in inspections of nonunion workplaces, even if those advocates aren't employees. The standard also may clarify union participation during inspections at worksites where workers are represented by organized labor. The Occupational Safety and Health Administration's proposed rule (RIN:1218-AD45) could essentially reinstate a policy OSHA adopted in 2013 during the Obama administration but was withdrawn by the Trump administration in 2017. The regulation exemplifies the Biden administration's commitment to organized labor in the workplace. OSHA set May as its target date for issuing a notice of proposed rulemaking, a step that requires the agency to explain options being considered for the standard and open a public comment period. Thanks Mike for the catch on the last ppt. The paddle on the left is not high enough. The MUTCD requires the paddle to be at least 5 ft. in height preferably higher. The one on the left is also to low, but is the wrong shape. Again according to the MUTCD the Stop side must be octagonal in shape. Slide #63 the paddle used during night work is too low. This month’s ppt is Spray finishing. It is much more than paint spray booths now. I used this when teaching OSHA in November. At the ASSP Three RIvers meeting. Several people said that they seeing more injuries from remote workers coming back to work at the facility. Slips, trips, and falls. Do you have a scaffold tag system and a competent person that inspects the scaffold? The Law Offices of Parente & Norem, P.C., Partner and head of our Work Injury Department Matthew J. Coleman, Trial Attorney Dennis M. Lynch, and Trial Attorney Taylor R. Matichak, obtained a $6 million settlement for a Local 13 carpenter who injured his back when he slipped on scaffold stairs at work. Again OSHA multi-employer case that was a victory. The Law Offices of Parente & Norem, P.C. Partners, Chris Norem, Joseph Parente, and Trial Attorney Dennis Lynch settled a case for $6,785,000 on behalf of a bricklayer foreman assigned to work on a building that was in need of a masonry repair in the garage area on the ground floor. While he and his crew were working on the repair, a 70 lb sheet of plywood fell out of a second story window of the building striking him on the top of his head and fracturing his C6 vertebrae requiring a C5-C7 double level fusion surgery with plates. OSHA multi-employer policy is the industry practice. A wind advisory means ensuring materials are secured. Another win. 35 years without a loss. Attorney Lynch did the opening and the entities settled that day. I am researching winter gloves. There is a balance between hand flexibility and warmth. OSHA News for November 2022 Hello, It was a month of audits. I was in Wheeling, Harvey, Decatur, Aurora, and Mokena. The CHST prep class had nine and many questions. The Construction Safety Council has a 145-hour class. https://buildsafe.org/Training/PageId/EventListView/CategoryId/25 is an excellent prep course for this test. The OSHA 511 class was 15 and had several large corporations in it. The periodic lockout inspection was a surprise for many. They thought every machine had to be locked out by an authorized person every year. Each authorized person has to be audited, but every machine does not need to be locked out as part of the audit. This month PPT is PPE in construction. I have seen climbing helmets with chin straps save lives. This will be common in 2025 for large sites. It is going to be a busy November, then quiet after November 20. I made the annual goal of 2000 people trained every year. Thanks to all that attended. Stay warm and safe in the cold. Bill was always to professional and gave many speeches on OSHA in the Chicago area. 2) Seven required OSHA programs for most manufacturers. With standards. When doing the audits, they are the ones that always come out. Required OSHA programs and training. OSHA 11: Chemical Hazard Communication. Need a list of chemicals. OSHA News for October 2022 Hello, It was good to see many at the ASSP conference. Dave Amos is retired and helping the conference. Robyn Coyne does Safety and Health at Harper College, and Eugene Saturn retired after 31 years with Exxonmobil. The month was hard with depositions from two large $55 billion- and $50 billion-dollar companies. The excellent defense attorneys go every detail in the CV and the expert report. With millions at stake, no one wants to lose. One trial was settled the night before. It was a multi-employer issue involving a scaffold. The General contractor has no scaffold tag program and that is the industry practice despite not being in OSHA. The ANSI A10.8 is clear on the use of red, yellow and green tags before other employees use the scaffold. Tool safety has been a popular topic since many companies are having recordable stitches from these tools from nail guns, grinders, hammers, saws, and mowers. The employee was exposed and the employer had no reason to believe that the exposure would occur. A photo of the hazard is one step. The other is the interview or proof that the employer know that the employee would be near the hazard. This can be done via an interview, signed statement or deposition. Many fatalities have this defense come up. I call it the head in the sand defense. 2. The employee violated the safety rule and exposed himself to a hazard. This requires the CSHO to get proof of the employer's written safety rule, proof the that training in the rule took place, the past audits, and the employer's discipline program. Very common with the employee not wearing PPE. 3. The violation just occurred unbeknownst to the employer. This requires the CSHO to get proof of the conditions' duration via interviews. Very common on fall protection citations. Someone took off the cover or guardrails etc. 4. The employer was in the midst of getting the hazard fixed and took precautions. Again interviews are necessary to establish what the employer knew of the hazards and a timeline of the action to fix the hazard. Common in trenching, PSM and housekeeping 5. The abatement will create a hazard equal or greater than the cited condition. This is requires the CSHO to know how long it would take to fix the cited condition and whether there is a longer employee exposure to the condition. Used on roofs by Dish TV installers, short term fall hazards etc. . 6. The condition is impossible to fix. It is a mini safety conference with top trainer talking on interesting topics. This month, I am teaching at the ASSP conference in Naperville. OSHA News for August 2022 Hello, July was a busy month with several audits and new clients. I am seeing some million dollar losses from trips and slips. Employers need to make sure the workplace is orderly and free of water as practical. The hot new safety product is the Pyramex Trifecta safety glasses. It has steel lens with holes.
