If you’re the CEO and get the safety audits, it is important to you get the issues fixed or assigned. You can not blame people when these issues are over a year old and someone dies. In accordance with 29 CFR § 1910.28(b)(13)(iii)(A), when work is performed 15 feet or more from the roof edge, each employee must be protected from falling by a guardrail system, a safety net system, a travel restraint system, personal fall arrest system, or a designated area. This is present at 70% of the companies for roof exposure. It is your interest to install guardrails or equivalent at the roof edge. I found 281 conveyor injuries in 2023. 140 were amputations. Many did not guard the in running nip points. ANSI B20.1 requires emergency stops/pull cords to help a worker caught in the machine. 1910.212(a)(1) requires guarding of the in running nip point. Do you use nitrogen? Do you have a nitrogen safety program? 100% of the companies that I have visited have no program for nitrogen safety. There have been 12 work fatalities since 2020 with nitrogen asphyxiation. Monitoring for leaks is key. Provided an oxygen detector and alarms. The Occupational Safety and Health Administration (OSHA) came in for blistering criticism from House Republicans at a hearing Wednesday, as Democrats defended the agency's work in the face of underfunding. Rep. Kevin Kiley (R-Calif.), chairman of the House Education & the Workforce Committee's Workforce Protections Subcommittee, started the hearing by mentioning that OSHA head Douglas Parker ran California's OSHA office -- also known as Cal OSHA -- during the first 2 years of the COVID-19 pandemic. "In June 2021, Cal OSHA proposed a rule that employees could go without masks in the workplace if and only if every worker present was vaccinated," said Kiley. "So a single identified unvaccinated employee would cause all employees to have to wear masks ... The rule was so widely criticized that Cal OSHA reversed itself the following week, but still forced employers to collect vaccination information from employees." "It was indicative of the uncertainty and irrationality that marked the COVID experience for businesses and workers in the state," he continued, adding that shortly after Parker was sworn into his current position, "OSHA published an emergency rule on workplace COVID-19 vaccination. The rule required employers with a total of 100 or more employees to develop, implement, and enforce a mandatory COVID-19 vaccination policy. Within 2 months, the Supreme Court ruled that OSHA had exceeded its authority in an unprecedented way." Rep. Mary Miller (R-Ill.) also lambasted Parker for the COVID emergency rule, which would have affected 84 million workers. "Now you want to tell Americans which Big Pharma shots they must take," she said. "I'm going to introduce amendments to strip you of your power and funding to protect the 84 million Americans who do not want to show you their vaccine papers ... OSHA needs to be reined in. They have gone far beyond their minor, limited mission." But Rep. Alma Adams (D-N.C.), the subcommittee's ranking member, defended the agency. "There's no question that OSHA is our nation's main line of defense against unsafe working conditions," she said. "In the 53 years since OSHA was created in 1970, worker injuries have fallen significantly and deaths from acute traumatic injuries have likewise come down sharply. Unfortunately, too many workers continue to be injured, made ill, or killed on the job." Because of chronic underfunding of OSHA by Congress, workers "are losing their lives to preventable hazards," said Adams. "Since fiscal year 2010, funding for OSHA has dropped by nearly 20% and in 2021, the number of OSHA inspectors was already near its lowest level ever ... It is disappointing to hear my colleagues proclaim that they care about workplace safety and then push for legislation like the Nullify Occupational Safety and Health Administration Actopens in a new tab or window" which would abolish the agency. And proposed Republican budget cuts "would slash OSHA's budget by 22%, causing OSHA to lose at least 270 inspectors and conduct 10,800 fewer inspections," she said. Parker, the hearing's lone witness, appeared unruffled during the proceedings. When Miller accused Parker of ignoring the Supreme Court and continuing "to press companies to fire American workers," Parker responded, "That's categorically untrue. We didn't threaten anyone and we didn't demand that anyone be fired ... Congresswoman, I believe that the American people expect their government to take on the big problems that are facing them. More than a million people have died of COVID [in the U.S.]." Miller responded by calling Parker "inept" and adding that the rule would have "terrorized our economy." OSHA's work on developing a standard to protect workers from extreme heat either indoors or outdoors also came under discussion. Rep. Mark Takano (D-Calif.) thanked Parker for his work to improve safety at warehouses and industrial facilities, noting that when he and a colleague toured a certain Massachusetts factory, "we expected to encounter a stuffy interior with all the machinery going. However, I was pleasantly surprised to encounter cool air coming from the circulated air conditioning system. This highlighted for me that really good employers know what they have to do to protect workers." Parker said that the agency learned from employers "that providing rest can lead to productivity gains. Workers slow down when they're overheated, and they're more prone to less mental focus. 5. OSHA News for August 2023 Hello, Another busy month. I settled two cases including $1.5 million for a plaintiff that was hit by another contractor. It was another successful multi-employer win. The other was a nice undisclosed settlement for a construction worker in a hot works case. The multi-employer guidance was used on the 50+ billion company successfully. The employer must ensure all ignitable products are covered within 35 feet of the hot works operation. The Lockout class this week was sold out. Locking out equipment and vehicles was the topics of interest. We have 19 people in the OSHA 2264 Confined space class next week at the Construction Safety Council. Today class was on office ergonomics. A company should review the workstations every few years to ensure the risk factors are low. I am glad most made it through back to back +116 heat days last week. The companies slowed it down, provided cooling and ice, started earlier and did morning training. Floor Openings, Floor Holes, Skylights and Roofs. states: (e)(2) Skylight screens installed below the skylight. Existing screens (i.e. burglar bars) shall meet the following requirements if they will be relied upon for fall protection: Screens installed at the same level or higher than the walking/working surface shall meet the strength requirements of subsection (b). Screens installed within 2 feet of the walking/working surface shall meet the strength requirements of subsection (b) with increased strength based on the fall distance below the walking/working surface as determined by a qualified person. In no case shall the strength of the screen below the skylight be less than the strength requirements of subsection (b). A screen more than 2 feet below the walking/working surface shall not serve as fall protection. A screen shall not be used for fall protection in accordance with subsection (e)(2)(A) or (e)(2)(B) if the broken skylight glazing will pose an impalement hazard to a worker who has fallen through the skylight and is lying on top of the screen. Skylights containing tempered, laminated, or plastic glazing, or similar materials shall not be considered to impose an impalement hazard. D. The screen construction shall be of grillwork, with openings less than 12 inches in the least horizontal dimension. 2) $1.3 Million dollar settlement. OSHA News for July 2023 Hello, I had a busy month of training. The WA DOSH compliance officers were sharp and had many questions. I am over 2000 trained this year. I went through 17 heat stroke cases that happened at work in 2022. 59% died with a heat index of 100F+ 35% died with a heat index of 90-99F 5% died with a heat index in the 80F. 35% died in Texas. I think 100+F is an area that requires more than an extra break, providing water, a buddy system, and training. What works for these 100F temps? The Food industry seems to have ice, cooling rooms, extra breaks, fans, and buddy systems for the 100F areas for workers. I refer the 30 hours to the NSEC, CSC, and others. What is required to be inspected every day before use per OSHA? The Lack of a $10 lock may cost the company their business. JLG wrote a letter to its dealer to recommend use of fall restraint lanyards in scissor lifts. OSHA News for May 2023 Hello, This was a nonstop month of training, editing work for clients, and conducting food audits. The food industry wants to be ready for the OSHA Inspections. I have done more food audits in the last six months than in the previous 12 years. 10 Most Common Citations in the food industry include: 1. Periodic Inspection does not have the machine and the person performing the inspection. 2. Written lockout procedures do not explain where the pressure gages are located. 3. Verification is missing in the lockout procedures steps. 4. No die block for the vertical compactor rams. 5. No guard or Gate for the pallet wrapping machines. 6. No training in the use of the 3000 psi pressure washer. 7. No maximum lift weight in the ergo program. 8. No max Pull Push forces in the ergo program. 9. Conveyors do not have emergency stop or pull cords where people are working. 10. No goggles worn for the cleaners using corrosives. I average 23 OSHA issues per inspection, so these are the most common. This Month's ppt is about residential fall protection. Many things have changed in the last ten years.
