OSHA July 2017 news

OSHA News
This month’s PowerPoint is minor servicing exemption in the OSHA lockout standard.  It is machine guarding or lockout. Sticking your hands in a machine exposes you unexpected re-energization, hazards of gravity or it is cycling again. Top 5 issues that I see over and over.
1) No specific procedures to lockout a machine.
2) No tag on a lock to identify who locked it out.
3) Cleaning people in the machine. No lockout or machine guarding. Are the cleaners authorized employees?
4) No lockout audits for authorized employees.
5) No records of the lockout training.  Was it on the job? Class room?
There were 60,000 opioid deaths in 2016. Some were heroin, some were legal pain killers. I have started talking about impairment at work with the companies. Many can be on legal drugs and be impaired. Do you want an impaired person running equipment or machines? Morning stretches with a job brief can pick up this impairment. So, do you train the managers what to do?
I am seeing so many people taking fake OSHA 30 classes and getting certifications in safety that are not really recognized. The CSP and ASP are accredited by the American National Standards Institute, the primary source for internationally recognized standards in U.S. based professional practice. The certifications are accredited through the ANSI/ISO/IEC 17024 standards for personnel certification programs.
National accreditation has become the yardstick for acceptance of a certification by many federal, state, and local agencies. Accreditation standards cover fairness in testing, audited financial disclosure, independence in governance, validated examination content, non-discrimination of candidates, and many other criteria.
BCSP is accredited by the National Commission for Certifying Agencies. The CSP was the first certification in safety, health, environment, and ergonomics accredited by this national organization which evaluates peer-operated certifications.

Last month’s OSHA News
1) OSHA lost Dorothy Dougherty — on a happier note — to retirement.  Dorothy had too many jobs to name in her 37 years at OSHA and MSHA, but I knew her best as Director of Standards and Guidance, and then as the career Deputy Assistant Secretary for the last several years.
2) The House Appropriations Committee released its FY 2018 Interior and Environment Appropriations budget bill today and it fully funds the Chemical Safety Board

4) The Occupational Safety and Health Administration will launch on Aug. 1, 2017, the Injury Tracking Application (ITA). The Web-based form allows employers to electronically submit required injury and illness data from their completed 2016 OSHA Form 300A. The application will be accessible from the ITA webpage.
Last month, OSHA published a notice of proposed rulemaking to extend the deadline for submitting 2016 Form 300A to Dec. 1, 2017, to allow affected entities sufficient time to familiarize themselves with the electronic reporting system, and to provide the new administration an opportunity to review the new electronic reporting requirements prior to their implementation.

OSHA April 2017 news

What a hectic month of training. May looks much easier and I will enjoy some days off. I revised my portion of the OSHA standards classes in the 511 and 510 this month. These students are always bringing mew fall protection items and other solutions to safety. Nearly all attendees are taking the classes to be a trainer so I have focused on the standards as well and class activities.

This month’s ppt is from the AGC fatality study. There are new data on construction fatalities. I plan to use this in the Intro to OSHA part of a 10/30 hour class.

John

Here is the news for April 2017

1) OSHA silica standard delayed until Sept. 23, 2017

https://content.govdelivery.com/accounts/USDOL/bulletins/192ac7a

2) The AGC did a study of fatalities. I was surprised at the low % of fatalities in commercial.
Industrial, Heavy, and Residential project locations, combined, accounted for roughly 90% of all fatalities.
Industrial project locations experienced the highest number of fatalities with 813 deaths (35%), followed by Heavy (29%) and Residential (25%) project locations.
Commercial project locations had the least fatalities (5%).
https://www.agc.org/industry-priorities/safety-health/construction-fatalities-study-0 is the link to download it.

3) Plan for Tornados. Here is a success story.
Feb 28
Naplate IL
Pilkington Glass had two tornado shelter.
Direct hit by F3 tornado
No one suffered injuries in Pilkington factory as result of tornado.

4) Peetee Guerrero is the new head of the National Safety Education Center at NIU. She replaces Missy Gilles who left for Kishwaukee College. Peetee has set the FY 2018 general schedule at the four NIU campuses.

5) AFL-CIO death on the job has several great graphs. 25% of all injuries are falls at the same surface. Four times more likely than falls from heights.
 https://aflcio.org/reports/death-job-toll-neglect-2017

6) OSHA is no longer insisting it has the right to invite union advocates to inspections of non-union worksites, according to an April 27 federal court notice filed by the National Federation of Independent Businesses.

7) New OSHA Fall Infographics for Construction

8) Question: If an employee with a neatly trimmed goatee is wearing a respirator and it does not interfere with the seal of the face piece or valve function, and has passed a fit test, does this meet the intent of the OSHA’s Respiratory Protection standard?’
Answer right here: https://www.osha.gov/pls/oshaweb/owadisp.show_document?p_table=INTERPRETATIONS&p_id=31025

9) Rare cease and desist order. The Michigan Occupational Safety and Health Administration (MIOSHA) executed a Cease Operations Order against Sunset Tree Service & Landscaping, LLC of Bay City for continuing to operate without abating hazards on the jobsite.

OSHA March 2017 News

Hello,

It was good to see everyone at the Construction Safety days, OSHA Safety Day, ASSE Three Rivers Meeting.

I manually compiled the February OSHA citations. What a pain of several hours. I miss the days to look at the press releases but no more. The no shaming the employer is the theme.

This month ppt is from my speech at OSHA Safety Day in Dixon. It is the top 20 audit items missed for industry inspections. It was popular and many have requested it since. I average 20 violations per industry audit and last year had two places with over 50 issues. Last year no one pass lockout audit criteria.

Here is the news for March 2017

1) The Bureau of Labor Statistics (BLS) identified several incorrect national-level fatality rates and hours worked in the Census of Fatal Occupational Injuries (CFOI). The affected data were fatal occupational injury counts, fatal occupational injury rates, and the total hours worked for selected occupations, industries, and a race/ethnicity category.

January 2017 OSHA Update

Hello,

March 6-7 is the construction safety conference in Oak Brook Terrace. I am teaching both days free for the council. Monday, I am teaching a CHST prep class. Last year all 8 students passed the exam on the first try. Tuesday, I am teaching lockout for construction.
Paul Satti is covering the new general industry fall standard there too. I plan to teach the new standard at the CSC so look for the schedule if interested.

The new general industry fall protection standard is this month’s ppt. The new standard renumbered all the old industry fall standards. The ppt was 50 Megs so I am using a pdf to send out. Slideshare can download it.

The top 5 topics taught last year were
1) Trenching
2) Rigging
3) OSHA 30
4) Confined Space
5) Crane Signaling

February and March are all booked so I appreciate people working around closed days. I figure we will not have an OSHA head until summer. So expect no new regulations for a while.

John

Here is the news for January 2017

1) Kelly Knighton is the new Regional Administrator of the agency's Dallas regional office. Knighton began her career with OSHA in 1995 as a Compliance Safety and Health Officer in Houston, Texas, where she investigated accidents involving manufacturing, construction, petrochemical, logging, maritime and oil and gas exploration. As a Compliance Assistance Specialist, she was instrumental in collaborating with trade associations, employers, local governments, universities and high schools to create partnerships and alliances.

2) OSHA new beryllium standard. The old exposure limit, established in 1949, was based largely on guesswork and dubbed "the taxicab standard" because a government health official and an industry medical consultant came up with the rule in the back of a taxi.
The new standard will be 0.2 micrograms per cubic meter, much stronger than what OSHA sought in the 1970s. Michaels said the Blade reports were instrumental in sparking OSHA to start work on the new rule as well as in prompting the Energy Department to take similar safety steps for workers at its facilities.

3) IL ROOFER IGNORES OSHA 19 TIMES, GETS $214,782 FINE

4) Final rule to keep OSHA 300,300A, 301 records for five years.

5) PA employer tells worker calling 911 for amputation to hang up. She is fired two days later.

6) Safety training schools and instructors will find few significant changes in OSHA's revised outreach training program guide released Jan. 3.
The guidance is primarily intended for instructors offering Occupational Safety and Health Administration 10- and 30-hour safety and health courses. The new guide, titled Outreach Training Requirements, replaces a document issued in 2013.

7) Tom Bielema has left OSHA as Peoria Director to join the world of Safety consulting.

8) White House officials called the directive a "one in, two out" plan. It requires government agencies requesting a new regulation to identify two regulations they will cut from their own departments. The officials insisted on anonymity in order to detail the directive ahead of Monday's formal announcement.

9) Sleep matters. At a national level, up to 3 per cent of GDP is lost due to lack of sleep, and an increase in sleep could add billions of dollars to a country's economy.

Large Work Payouts
1) A Chicago federal jury on Tuesday awarded more than $5 million to a couple who suffered back injuries after a Freightliner truck crashed into their vehicle on an southern Illinois highway.

Major news stories.
1) Three Dead workers in a restaurant shooting.

2) Hydrogen Sulfide kills three in FL manhole.
