April 2015 OSHA News

This month’s draft powerpoint is trenching safety. I thought I had done one more recently since 2005.
http://www.slideshare.net/johnanewquist/trenching-2014-year-in-review-47703717?utm_source=slideshow&utm_medium=ssemail&utm_campaign=post_upload_view_cta

I want to thank John Gryzwacz and Bob Lomastro for helping me with last month’s presentation on electrical safety. They are the best electrical trainers in the country. Both teach the OSHA 3095 class at the many OSHA Ed Centers. I recommend that all safety professionals take the three day class because it gets into to depth of the electrical standard that cannot be covered in 1-2 hours. Many OSHA compliance officers will take a similar three day class at the OSHA Training Institute.
Bob is at www.safetywizard.com
John is www.oshaprofessor.com
These presentation are always in continual improvement so I put a date on the draft.
I included a fact sheet AC Voltage sensors from Fluke who was kind enough to send this to me.

Here is the news for April 2015

1)  OSHA is inspecting about 40 percent of the worker injury or fatality incidents that they learn about through the new federal reporting
rule, OSHA chief David Michaels tells a meeting of the Advisory Committee on Construction Safety and Health. – BNA

2) ASSE has moved into their new Headquarters building at 520 N. Northwest Highway, Park Ridge, IL 60068.  Their phone number, 847-699-2929, remains the same.

3) I was interviewed by Safety + Health magazine on OSHA inspections.
Certain employees may be selected for a one-on-one interview with the compliance officer. Identify a private area – a conference room, for example – that can be used for these interviews. The questions will be simple – covering topics such as the type of training provided – and employers should tell their workers to answer any questions truthfully, Newquist said.
Always tell the truth. Jail is not worth it.

http://www.safetyandhealthmagazine.com/articles/11995-preparing-for-an-osha-inspection?page=2

4) Final Confined Space in Construction Rule Clears White House Review
A draft final rule for confined spaces in construction is back with OSHA, following completion of a review by the White House Office of Information and Regulatory Affairs. The review by OIRA is typically the final outside regulatory analysis before publication of a rule, and OSHA expects to release the final rule soon, spokeswoman Lauren North tells Bloomberg BNA

5) The Occupational Safety and Health Administration today published a proposed revision to its Eye and Face Protection Standards that updates personal protective equipment requirements in the agency's general industry, shipyard employment, longshoring, marine terminals and construction standards. The proposed revisions will reflect current national consensus standards and ensure that employers use up-to-date eye and face protection during hazardous workplace operations.

6) I have push 100% barrier guarding for lathes. Here is yet another lathe death. This Elk Grove Village.

http://www.chicagotribune.com/suburbs/arlington-heights/news/ct-elk-grove-industrial-accident-met-20150415-story.html
7) OSHA ranked 113 out of the 315 federal agencies as the best places to work for. Ten years ago, it was in the bottom quarter.

http://bestplacestowork.org/BPTW/rankings/detail/DLSH

8) Congrats to Erin Denova for being promoter to WB investigator.

9) CA Safety Director and managers charged in death of worker. Rodriguez, 63, of Riverside and Florez, 42, of Whittier could face up to three years in prison and fines up to $250,000 if convicted of all charges9 ADD Trench Steel Plate
http://abc7news.com/684362/

10) I am seeing steel plate used to support trenching. This method is allowed if there is tabulated data to prove that the protective system will hold. Too often there is no data to back up this is safe.

11) Congrats to Ken Montgomery for being promoted to the Cincinnati Area Director replacing Bill Wilkerson who retired after 38 years in the agency.

March 2015 OSHA News

This month’s draft powerpoint is electrical safety for general
industry. I used this in my OSHA 10 hour classes. I find it could go 2
hours if needed. I was thinking I put this out, but I could not find a
month that I sent this out.

http://www.slideshare.net/johnanewquist/gi-2015-electric-safety

It was exceptionally busy in March. I can’t believe that I trained
over 400 this month. It was nonstop.

There are many good worker Memorial Day Events this month.

NEBRASKA'S 4th ANNUAL FREE SAFETY EXPO features Matt Stein, OSHA, and
others speaking.
April 28, 2015 .... please email Tonya Ford at tonyaford@usmwf.org if
you need a registration form.
There is limited space available at this year's Safety Expo please
submit your form as soon as possible to guarantee a spot at this
year’s sessions as there are a lot of amazing experts.
http://www.usmwf.org/pdf/USMWFFlyers/safety_expo_form.pdf

I will speaking at the Workers Memorial Safety Day Monday, April 27th
in Cadillac, Mi! I will be discussing Trimming Safety. It will be
free. Email me for details April 20th.

The new reporting rule that requires employers to call in amputations
is revealing how inadequate guarding and lockout is at many
facilities.

I have to renew my construction OSHA Train the Trainer so will have a
relaxing OSHA 502 April 21-23 at the Construction Safety Council.

Here is the news for March 2015

1) Two years in jail for director for the death of a worker.
http://buzz.blog.ajc.com/2015/03/09/guilty-plea-avoids-trial-for-midnight-rider-director/

2) Thanks to the people who caught the ppt error on medical
evaluations for respirators. It is initially for this and not
annually.

3) I am seeing a rash of fall lanyards with severe corrosion. From the
manufacturer’s inspection guidelines: "Snaps: Inspect closely for hook
and eye distortions, cracks, corrosion, or pitted surfaces."

4) 55 gallon drums have zero rating to lift parts once holes are cut
into the sides. Four drums found in 2015 already from site audits.

5) Vote for regs and ideas that OSHA should consider.
http://dolregs.ideascale.com/a/ideas/top/campaign-filter/byids/campaigns/15893

6) OSHA penalty structure is not correct in the Field Operation Manual
because they put out an interim guidance. For example the FOM gives a
Medium Lesser $2000 in Table 6-2.
https://www.osha.gov/OshDoc/Directive_pdf/CPL_02-00-148.pdf
The 2012 guidance makes the Medium Lesser penalty $4000.
https://www.osha.gov/dep/enforcement/admin_penalty_mar2012.html

7) This plywood fence death that killed a pedestrian raises a tough
issue for contractors. How much wind should the fence be designed for?
40 mph? 60 mph?
http://www.nydailynews.com/new-york/plywood-fatally-strikes-woman-37-manhattan-sidewalk-article-1.2153435

8) Good question on propane storage
What restrictions apply to the storage of propane cylinders in buildings?

The storage of propane in buildings is limited: Buildings frequented
by the public are limited to cylinders with a propane capacity of 1
pound. The total quantity stored is limited to 200 pounds of propane.
Buildings not frequented by the public are limited to a maximum
quantity of 300 pounds of propane. The cylinder size is not
restricted.
http://www.nfpa.org/Assets/files/AboutTheCodes/58/58_FAQs.pdf

9) The deaths in mines were 260 in 1970. Last year it was 16. The
fatality rate also dropped 90% from 200 dead/100,000 miners to 20/100k
http://www.msha.gov/newsinfo/2015/0326-coal-act/

10) Electrical cords should be inspected daily. I am seeing audit
after audit where these are missing.

employers can't comply with a 45 old law today?

Requiring the Commissioner of Labor and Industry or an authorized
representative of the Commissioner to provide an employer written
notice of an intent to inspect the place of employment, at least 14

4) OSHA Jordan Barab said the following rules are pending final agency action:
• Silica
• Subpart D: Walking Working Surfaces and Personal Fall
Protection Systems (Slips, Trips, and Fall Prevention).
• Improve Tracking of Workplace Injuries and Illnesses (also
known informally as Electronic Recordkeeping Rule)
• Confined Space in Construction

5) OSHA Hospitalization, Amputations Reporting triggers
Inspection Triggers. OSHA nonpublished memo said these reports by
companies to OSHA automatically trigger an inspection—
Category 1 reports— any of these trigger an inspection:
- a fatality;
- at least two hospitalizations;
- any injury of a worker 17 years old or younger;
- similar events at the worksite involving multiple injures that
occurred in the past year;
- employer history of repeat, willful, failure-to-abate or egregious violations;
- employer previously designated as a severe violator;
- employer covered by national or local emphasis program; or
- any imminent danger
Answer ‘Yes,’ Get Inspected.

Reports that could trigger an inspection if at least TWO of the
following questions below are answered ‘‘yes’’ will be recorded as
Category 2 reports,
The Category 2 questions are:
- Were temporary workers or ‘‘other vulnerable populations’’ injured
or made ill?
- Does the employer participate in a cooperative safety program such
as the Voluntary Protection Program or an alliance?
- Are employees still exposed to factors underlying the hazards
producing the injury or illness?
- Was the incident the result of failure of a safety program such as
lockout/tagout or process safety management?
- Were employees exposed to a serious hazard such as falls,
combustible dust or heat?
- Is there a pending whistle-blower complaint or inspection?
- Does the employer have a history of OSHA inspections?
- Did another government agency make a referral?
- Were health issues such as chemical exposure and heat stress involved?
If the answers to the Category 2 questions are ‘‘no,’’ then an
inspection may not be warranted

6) Update to the Neri Criminal trench jail. He was released from jail
December 24 after serving three weeks.
• Neri was permanently enjoined from engaging in trenching,
excavation, construction or related activities and permanently
prohibited from possessing or leasing any construction excavation
equipment.
• The judges also found that Neri, based on a review of his
tax returns and other financial records, was unable to pay the
$110,440 fine.
• However, the judges said the government ‘‘may continue to
pursue collection through an appropriate tribunal

7) Congrats to Julie Evans for her well-earned retirement. I worked
with Julie on and off since she started. She was a tireless hard
working person and was a great team leader.

8) Congrats to Sherrill Benjamin for his hard working whistleblower
manager career. He was an attorney and taught me nearly everything I
know on discrimination and whistleblower. I did several audits with
him and he was always a hardworking man.

9) Congrats to Dana Root on her retirement. Dana Root was the first
ergonomist I had a chance to work with extensively. She had the
patience to show me all the tools needed to conduct an ergonomic
evaluation.

10) Congrats to Nancy Nash for her promotion to the Regional Office in
Enforcement programs.

11) I audited 12 large construction company respirator programs. Three
issues were common. Lack of Medical Evaluation initially, No Annual
Respirator Training, and No quantitative or qualitative respirator fit
test. Most used did not know how to do a filtering face piece user
seal check.

12) I looked at 10 companies’ body harnesses and energy absorbers.
80+% had harnesses over five years old with some 17 years olds. About
50% of the snaphooks and carabiners did not have the gate strength
stamped on the gate. It should be 3600 pounds or higher.

3) Company agrees to hire a safety director after OSHA inspection.
Also, the company has hired a safety director, Barry Lassiter has the
title of MFG's Director of Environmental, Health, Safety and Security.
His "top priority will be to create a new culture of safety at the
company's Kimberly Park facility," according to an MFG announcement
regarding his October hire.
Let's hope they start a safety commitment with top management buying into this.

tragedy," said Jacob Scott, OSHA’s area director in North Aurora. "No
one should have to endure such a painful loss ever. Inspecting and
making sure protective equipment is in use and working properly is a
common-sense safety procedure that saves lives and prevents injuries.
Companies that ask their employees to work above the ground have a
responsibility to provide adequate fall protection to workers. OSHA
has seen a disturbing trend in preventable deaths and injuries in the
telecommunications industry.” - See more at:

This year, I am tracking the Illinois worker fatalities. I can find 14 for 2015.

I set record training in February with nearly every day teaching 400
people I am up to 588 people trained in 2015. So much for slowing
down. I am booked every day in March including three Saturdays.

January 2015 OSHA news

This month’s draft powerpoint is the most frequently cited for FY2014
for construction and general industry. I want to thank the OSHA people
who work hard in getting the data together. This is much more
expansive than what OSHA gives to the public in speeches.

http://www.slideshare.net/johnanewquist/fy2014-mfc-general-industry
http://www.slideshare.net/johnanewquist/fy2014-mfc-construction-osha

For 2015, I want to concentrate on trenching safety for construction,
tree trimming safety for service sector, and lockout for general
industry. I see these as common problems for years and want to make a
ppt that shows more how to do it right. I will be glad to come out
free and take a look at your company and give you a verbal assessment
how good your company’s program is and how it compares to the hundreds
that I have seen.
The Manual of Uniform Traffic Control Devices is only over 700 pages.

Here is the news for January 2015

 1) NFPA estimates that 65,880 firefighter injuries occurred in the
line of duty in 2013.

http://www.nfpa.org/research/reports-and-statistics/the-fire-service/fatalities-and-injuries/firefighter-injuries-in-the-united-states
 2) Coal-fired electric power plants would have to begin monitoring
workers’ exposure to inorganic arsenic and filing reports with OSHA
per new FR proposal.

https://www.osha.gov/pls/oshaweb/owadisp.show_document?p_table=FEDERAL_REGISTER&p_id=24887
 3) OSHA cites willful on trench death of a 22 year old man in Fort Bragg NC>

http://www.wral.com/company-cited-in-fatal-fort-bragg-trench-collapse/14337060/
 4) OSHA budget was provided a funding level of $552.8 million

Of course, if one takes into consideration upcoming federal salary
increases and inflation, OSHA actually has less to spend than last
year.

Changes from FY14:

• Federal enforcement received a $215,000 increase in FY15

• Whistleblower protection received a $500,000 increase in FY15

• State Programs received a $950,000 increase in FY15

• Federal compliance assistance took a hit - $1 million less for FY15

When Congress approved OSHA funding for FY15, the bill had several
riders on it that may impose some potential problems for the agency.

The riders:

• Require OSHA to notify the House and Senate committees of any new national,

regional or local emphasis programs as well as the data used to determine the

new program.

• Require the agency to consider all new currently available technology as the

agency moves forward with the silica rule
 5) New OSHA spreadsheet for fatalities looks good.

https://www.osha.gov/dep/fatcat/fy15_federal-state_summaries.pdf
 6) Retired OSHA AD - Bill Murphy "a legend in his agency" speaks on
the Cincinnati collapse.

I was trying to see if he was dead this weekend. Great to see that he
looks healthy.

http://www.local12.com/news/features/top-stories/stories/exosha-chief-weighs-deadly-collapse-23752.shtml
 7) Maine, has adopted public sector protection for its employees,
will come on board this year, is the latest state. .
 8) OSHA Training Institute revised the required OSHA 10/30 handouts.

• Introduction to OSHA Instructor Guide

• Page 6 - Updated data on fatalities for 2013.

• Page 13 - Reporting requirements updated to reflect recent
standard changes - Reporting within 24-hours for amputations,
hospitalization, or loss of eye.

• Page 18 - Reporting requirements updated to reflect recent
standard changes - Reporting within 24-hours for amputations,
hospitalization, or loss of eye.

• Introduction to OSHA Power Points

• Replaced slide #3 - Statistics update

• Replaced slide #18 - Reporting requirements

• Updated Handouts #1 through #8

The revised "Introduction to OSHA" module must be incorporated into
trainer classes and Outreach training classes, as soon as possible,
but no later than April 1, 2015.

 9) Kansas to become state plan is essentially dead.

http://www2.ljworld.com/news/2015/jan/21/plans-state-take-over-osha-enforcement-still-has-s/
10) Congrats to Nancy Hauter for become the second Region 5 Deputy
Regional Administrator. Nancy had worked at the OSHA training
Institute, The OSHA Directorate of Enforcement and the Region 8
Assistant Regional Administrator.
 11) OSHA Final Rule for Walking Working Surfaces and Personal Fall
Protection Systems (Slips, Trips, and Fall Prevention) in General
Industry is schedule to come out in June 2015.

http://www.reginfo.gov/public/do/eAgendaViewRule?pubId=201410&RIN=1218-AB80
 12) OSHA in Region 5 had 111 investigated fatalities. 42 Illinois. 18
in Wisconsin 51 in Ohio.
 13) My Informal poll about the new reporting rule revealed three
issues. OSHA gets about 350 calls a week. Many have safety systems and
trained people that call. What is not occurring as much is calls from
small employers and temp employers. They are also seeing people call
in when not sure which creates another problem, how is this handled?
14) BLS has more details of deaths at work for 2012. For example, 30
construction workers died from violence. The second link is an easier
2010 link for just construction.

OSHA News for Decmeber 2014

This month’s draft powerpoint is Top 2015 issues for contractors. Most sites are excellent for safety and have no accidents. The sites do have hazards though. I am surprised how many of these same hazards occur on these $100 million dollar projects.
This is not a ppt that I presented rather an informational guide for a large contractor that I worked with in December.
http://www.slideshare.net/johnanewquist/construction-safety-issues-for-2015

This year, I am tracking the Illinois worker fatalities. I can find 64 for 2014.

It was busy month of training with 153 people trained. My original goal for 2014 was 2500 people trained. I ended the year with 2170 people trained.

Here is the news for December 2014

1) FREE SPANISH FALL PROTECTION CLASS
The “Latino Worker Resource Center” also known as the “El Obrero Latino” presents
the following safety compliance class in Spanish, for a limited time at no cost:
*The class includes books, class certificates and/or class completion identification card.

2) The Confined Space in Construction Final Rule has been proposed for April 2015.
http://www.reginfo.gov/public/do/eAgendaViewRule?pubId=201410&RIN=1218-AB47

3) Key findings from the BLS 2013 Survey of Occupational Injuries and Illnesses
• The total recordable cases (TRC) incidence rate of injury and illness reported by private industry employers declined in 2013 from a year earlier, as did the rate for cases of a more serious nature involving days away from work, job transfer, or restriction—commonly referred to as DART— marking the first decline in the DART rate since 2009.

4) OSHA to get slight increase in funding for 2015.
http://www.safetyandhealthmagazine.com/articles/11531-budget-agreement-would-give-slight-bump-to-osha

5) IL Trenching contractor A Lamp cited again by OSHA. "The company, cited multiple times since 2008 for similar violations, has already paid more than $170,000 in fines."
"It's absurd to think that a company would put a worker in harm's way to save time or money," Allen said.

http://www.chicagotribune.com/business/ct-worker-safety-1210-biz--20141209-story.html

6) Jake Frisella, a 21-year-old machine operator, was fatally crushed at Ventra Belvidere LLC while reaching into a machine to align parts made for Chrysler vehicles on June 10, 2014.
“This tragic death was preventable if Ventra Belvidere ensured proper machine guarding,” said Jacob Scott, OSHA’s area director in Aurora, Illinois. “Failure to protect employees from dangerous machinery often leads to catastrophic injury or death.

7) Seven willful citations in ILconfined space death.

8) Former Asbestos Removal Trainer Pleads Guilty to Falsifying Hundreds of Certifications
Lachele Rene Thrower, who worked for an approved asbestos removal training provider, with willfully making materially false statements to the Environmental Protection Agency over the course of four years. Thrower admitted to falsely certifying between 100 and 150 workers from May 2010 to August 2014
Thrower could face up to five years in prison and a fine of more than $250,000.

9) New Osha reporting requirements take effect January 1, 2015. Dr. Michaels noted that when employers call in to report a reportable event (fatality, amputation, in-patient hospitalization, or eye-loss) that OSHA will engage in a conversation with the employer. According to Dr. Michaels this is a new approach for the agency, however, he claimed that the agency’s objective is to help employers. When OSHA is notified of a reportable event the agency will inquire as to how the event occurred and what type of investigation the employer is or will do to determine the cause. Additionally, Dr. Michaels stated that OSHA will have a new website up by January 1st which will allow employers to report online.

10) Former Peoria OSHA discrimination investigator Jim Lucera passed away at the age of 70 in Pekin on December 4, 2014. Jim was always a nice guy to be around and loved the Peoria area.

11) OSHA’s Dr. Michaels “OSHA is exploring a variety of other actions to improve the safety of chemical facilities. These include considering changes to our emergency response standards, considering regulatory changes to improve ammonium nitrate safety, and modernizing and updating the PSM standard and policies, as well as developing targeted outreach and guidance products as appropriate.”

https://www.osha.gov/pls/oshaweb/owadisp.show_document?p_table=TESTIMONIES&p_id=1665

12) Historic fine for retaliation. Metro-North Commuter Railroad Co. In fining the railroad $260,000 plus legal fees, the U.S. Department of Labor said it found a culture of intimidation, in which supervisors actively tried to discourage workers from filing injury reports and punished workers who did.

13) Marthe Kent, Former Regional Administrator of Region 1, passed away on December 9th. Marthe was a strong advocate for the worker and will be missed.

http://www.legacy.com/obituaries/washingtonpost/obituary.aspx?pid=173463795

14) Marsha Drumm was named the Kansas City Regional Administrator. Congrats, she was Deputy RA for years.

15) It was with great sadness that I learned of the passing of a fellow safety professional Hiliary H. Holloway on December 21, 2014. I worked with Hillary over the years and he was always a positive force for change and had the best smile.
