OSHA January 2022 News

OSHA News for January 2022 Hello, The Omicron virus seems to be everywhere. My friends and family reported cough and congestion. Lower back ache, runny nose, and nights have been reported also. Testing recommended if you could find a test kit or appointment at a clinic. This months ppt is construction crane safety. It has been a long time since I covered this in the newsletter. Many of the deaths happened in the tower crane area the last few years. OSHA News for December 2021 Hello, This was a crazy busy month with work everyday. The New OSHA ETS on Vaccinate/test came out. The 5th circuit said no. The 6th circuit will hear the case. Thanks for all the classes and audits. Registration is Open for 145-Hour Safety Administrator Certificate Course. This is one of the best preparation classes for the CHST. Dozens have passed the CHST on the first try after completion. You will earn many certificates along the way. It starts December 7 – May 12 on Tuesday and Thursday via ZOOM. Classes are 6-9pm. He has worked in the Region 15 years and was great in Enforcement programs and Deputy RA/ 2) The Biden administration is asking the 6th US Circuit Court of Appeals to wipe away an order from another appeals court blocking its Occupational Safety and Health Administration vaccine mandate. Several lawsuits were brought challenging the OSHA mandate, and last week the cases were consolidated in the 6th Circuit, an appeals court that leans right, as 10 of its 16 active judges are Republican appointees. 3) The House passed H.R.5376. This has the $700,000 willful and $70,000 Serious. OSHA November 2021 News

OSHA News for Newsletter November 2021 Hello, Where did the month go? The training was in demand and every day was training or audits. The months of November are booked out, and January is 50% booked. In January 2021, six workers died in the poultry plant freezer area. The freezer has liquid nitrogen to flash free the chickens. Foundation Foods citation for nitrogen is a gamechanger. Here are the elements of the citation. a - On or about January 28, 2021, at Plant 4, Employees were exposed to thermal and asphyxiation injuries or death caused by hazards resulting from the uncontrolled release of liquid nitrogen and nitrogen vapor from the liquid nitrogen system, including but not limited to the Line 2 freezer equipment, the Line 4 freezer equipment, and the storage tanks, that was not operated in a manner that would protect employees from serious injuries and death. Among other methods, feasible and acceptable means of abatement include: a - Ensure oxygen deficiency monitoring and alarm system, with both audible and visual notification, is installed within enclosed areas and use of personal oxygen monitors, where the liquid nitrogen (LN2) process equipment operates. b - Ensure the process enclosure ventilation system design provides adequate air movement (i.e., air changes per hour) across all portions of the room or area to prevent the accumulation of nitrogen vapors. c - Ensure the liquid nitrogen process equipment including the Line 4 liquid nitrogen Immersion/Spiral freezer has signage identifying the source isolation valves. d - Develop and implement operations procedures for both normal startup, shutdown, and emergency shutdown conditions, as well as equipment maintenance procedures for cryogenic systems at the facility including the Line 2 liquid nitrogen Spiral freezer and the Line 4 liquid nitrogen Immersion/Spiral freezer. e - Ensure respiratory protection is provided for employees needing to enter a space where the quality of the air in that space is uncertain. f - Ensure the liquid nitrogen receiving/supply vessels are inspected and certified for operation. g - Ensure the liquid nitrogen offloading/fill connection is located at least 10 ft. away from building exits. h - Secure liquid nitrogen bulk handling and process equipment from physical damage or tampering. No industry standard was mentioned, but it shows what OSHA may use in the future. This month ppt is Fall Protection in Industry. It is a topic I teach 1-3 times a month so it is important for industrial companies. Every worker exposed to a fall over 4 feet must have training to avoid falls. Will OSHA penalties go to $70,000 for serious and $700,000 for willful. Many are watching the legislation. See OSHA #1. OSHA News. 1) Latest proposal is a deal between President Joe Biden and Senate moderates for a $1.75 trillion social spending package maintains the previously announced proposal to raise statutory penalties for OSH Act violations by a factor of 10, along with $707 million in funding for OSHA itself. H.R. 5376 , unveiled by the House Rules Committee the afternoon of Oct. 28 soon after Biden announced a new “framework” for his signature social spending and climate.. 2) Doug Parker passed confirmation by the U.S. Senate as head of OSHA 3) Ron DeSantis asked for Florida to be a state plan. Florida should remove itself from the direct federal oversight of the Occupational Safety and Health Administration, they said. The proposal was a reaction to President Joe Biden’s administration announcing a rule, to be enforced by that agency, that says private businesses with 100 or more employees must require their workers to be vaccinated against the coronavirus or undergo weekly testing. 4) OSHA is Hiring in Naperville Illinois An announcement to fill a vacant Safety and Occupational Health Specialist in the Naperville, IL, Area Office opened today, October 22, 2021, and will close on November 4th. There are two announcements, one has a language requirement. Links to both announcements are below. The job is open to the public. I have had many in the classes where the adults want to talk about Vaccinate or be fired policy. Many said that they had covid. None of the 30+ had an antibody test. None of the employers who fire the worker are accepting a positive antibody test. This will cost the employers millions in wrongful discharge. The vaccine is given to produce virus antibodies. I paid for a friend to get an antibody test last week., She had a strong level of antibodies from Covid in August. Why would you fire this person? This person has scientific proof that she has antibodies. The failure to consider this test is a flaw in the mandate. Most of the 30+ said this would take a $75 test. 6) The federal government is threatening to take away approval of South Carolina’s workplace safety plan because the state hasn’t adopted federal safety standards for health care settings put in to protect against the spread of COVID-19. Gov. Henry McMaster is vowing to fight the proposed takeover in court; he tweeted Wednesday. South Carolina, along with Utah and Arizona, have not adopted temporary health care settings standards. Those standards include requirements to provide some employees with N95 respirators or other personal protective equipment, and ensure 6 feet between workers. If 6 feet is not possible, employees should have barriers between workers. TOP VIDEOS × The Occupational Safety and Health Administration standard also requires providing workers with paid time off to get vaccinated for COVID-19 and to recover from any side effects. Those standards were established by OSHA in June, and have to be included in the state’s work safety plan. 7) JEFFERSON COUNTY, Texas — The US Department of Labor’s investigation into an April 2021 crane collapse that killed two men on Interstate 10 west of Beaumont revealed Thursday that a Lufkin contracting company will face penalties for failing to assemble the crane properly. The investigation is blaming the crane operator for the crane collapse. The U.S. Department of Labor’s Occupational Safety and Health Administration cited Hemphill WBE Pile Driving Co. Inc. for three willful and two serious violations. The violations include operating a crane beyond its rated load capacity and failing to assemble the boom properly, according to a news release. The company faces $212,599 in proposed penalties. The investigation determined Hemphill WBE Pile Driving Co. Inc. was installing supports for an elevated section of the highway on April 22, 2021. OSHA found the operator failed to determine the correct weight of the load while using the crane to retrieve a helmet box and hammer driven 3 feet into the ground. The incorrectly assembled boom buckled and landed on the vehicle, the release says. The driver of an I-10 westbound Toyota pickup, Sarfaraz Karowadia, 37, and his passenger, Altaf Kasowadia, 42, both of Friendswood, were killed when the boom landed on top of the truck near Smith Road, according to a news release from the Texas Department of Public Safety. “Two people died senselessly because Hemphill Pile Driving failed to follow assembly instructions and federal regulations," said OSHA Area Director Mark Briggs in Houston. "They endangered their employees and every person driving on this section of Interstate 10. OSHA News for August 2021 Hello, This was a month of audits. I got to go to some large companies and see some good best practices. I am seeing many China Shackles used. One Chinese manufacturer said the shackle was not to be used for personnel safe lifting or lifting safety. This month’s powerpoint is a custom one that I did for a large mechanical contractor. They wanted all employees to learn some lockout and confined space. The workers that would enter a confined space or lockout would take a four hour version. Custom training is the growing area of safety. They said the past lockout was only for machines that they would never lockout. Online training is ending, and classroom training is in demand. And 55 are in the ICU.” “In the ICU, 55 people are fighting for their lives and only one of them is unvaccinated.” “Most of the patients are in their 30s and 40s and it is very sad to have someone die in the ICU by themselves without a touch of someone’s face of seeing loved ones,” said Juana Mejia, a COVID ICU nurse manager. Health officials in Austin, Texas, issued a dire warning on Friday: There are only about 16 staffed ICU beds left for the entire region, an 11-county area that's home to more than two million people. It's the lowest number of ICU beds available in the region since the pandemic began, the city said. Since July 15, hospitalizations in Dallas County have increased from 181 to 397, according to Dallas County Judge Clay Jenkins. The number of patients in the ICU has increased from 53 to 120 over the same time period, Jenkins said. The pandemic wreaked havoc on health-care workers and non-English-speaking immigrant workers in the manufacturing, agriculture, and meatpacking industries. The administration’s plans to increase inspectors is driven by frustration with the Occupational Safety and Health Administration’s inability to respond to an overwhelming number of worker complaints. OSHA will now need to focus on hiring multilingual staff with an array of technical skills and understanding of workplace dynamics, said Rebecca Reindel, director of occupational safety and health for the AFL-CIO. The buildup would also cost tens of millions of dollars annually and require a long-term financial commitment, according to the president’s fiscal 2022 budget proposal. As of April, OSHA had 748 inspectors, officially called compliance safety and health officers, according to the agency. In the field, they’re supervised by about 200 area office directors and assistant directors. The 2022 enforcement budget would grow 10% from fiscal 2021 to $254.6 million. Over the coming fiscal year, OSHA would create 155 new inspector positions and add 52 other jobs, including assistant area directors and technicians. Altogether, OSHA’s enforcement staff would grow to 1,545 positions in 2022, a 15% increase from 2021’s 1,338. Another 85 inspector positions were funded for fiscal 2021 by a Covid-19 relief bill, the American Rescue Plan Act, passed in March. Once the new inspectors are in the field, they’ll likely respond to severe injury and hospitalization reports from employers, while inspectors with three or more years of experience will handle inspections that require more planning, such as checking factories for machine hazards and chemical processing plants, according to OSHA’s spending plan. OSHA News for May 2021 Hello, It was a long busy month. June should be a little easier. Most of the month and July are booked. I am seeing much work in OSHA settlement training. The CHST prep class on May 17-21, 2021 already three have passed the examination. Next one in the fall. An Audit of a large Japanese company showed these Program and Training Deficiencies. 1. Missing energy control procedures for robots. 2. No Periodic inspections for authorized people in the plant. 3. Lockout training was missing for some. 4. No fall protection training for workers who access the roof. 5. Workers (Supervisors, Industrial Machine Operator, Forklift Operators, and Welders, have not received Electrical Safety-Related Work Practices training. 6. Some forklift operators were missing recertifications. 7. Respirator fit tests need to be done for workers wearing a half mask respirator. 8. Aerial lift operators did not have proof of training. 9. No ladder training for those that use ladders. A good audit should pick up these weaknesses. If an accident would occur, it will be hard to explain that you are missing these programs in a large corporation. SPRINGFIELD – Workers at high hazard facilities could soon be required to undergo advanced safety training thanks to legislation passed by the Senate Executive Committee yesterday. State Senator Michael E. Hastings (D-Frankfort) is the chief sponsor of this initiative. “Safety training is crucial at every job site, but the need at facilities where workers are handling dangerous substances is especially prudent,” Hastings said. “Those who have gone through proper training are statistically less likely to be at risk of making a mistake that could result in an accident. We cannot afford to lose lives on the job site due to neglect, and we certainly cannot afford to let these dangerous chemicals seep into our communities.” This initiative is a response to a 2012 Chevron refinery explosion and subsequent fire in Richmond, Cal. According to the U.S. Chemical Safety and Hazard Investigation Board, approximately 15,000 people from the surrounding communities sought medical treatment at nearby medical facilities for ailments including breathing problems, chest pain, shortness of breath, sore throat, and headaches following the incident. Approximately 20 of these people were admitted to local hospitals as inpatients for treatment. Under House Bill 3437, the Illinois Department of Labor would be required to develop a curriculum of approved advanced safety training for workers at high hazard facilities. These building and construction contractors would be required to pay prevailing wage and use a skilled and trained workforce to perform all onsite work at petroleum refining facilities, petrochemical manufacturing facilities, ethyl alcohol manufacturing facilities, and basic organic chemical manufacturing facilities. If these contractors fail to do so, they could face a monetary penalty. Amazon announced the launch of WorkingWell, a new comprehensive program providing employees with physical and mental activities, wellness exercises, and healthy eating support that are scientifically proven to help them recharge and reenergize, and ultimately reduce the risk of injury. The program is part of the company's investment of more than $300 million into safety projects in 2021, and its mission to be Earth's Safest Place to Work. There are a number of components of WorkingWell, each of which was developed in collaboration with employees from within Amazon operations. Aspects of WorkingWell piloted in the U.S. in 2019, and the program has since expanded to 859,000 employees at 350 sites in North America and Europe. OSHA News for March 2021 Hello, March was record busy with training. Construction companies want training specific to their trade vs general hazards such as falls. This month’s powerpoint is circular saw safety. This old time saw seems to have a steady stream of amputations and hospitalization. Every company should have the saw manual and provide some training to workers that will use it I got the Pfizer vaccine two Fridays ago. It went smooth at Northwestern hospital. In and out in under 30 minutes. There were no side effects for me. Wish me luck April 9 for the second shot. A record three criminal cases were announced in March. The cylinder cart must be specifically designed to hold/carry oxygen and acetylene cylinders in the upright position. The cylinders must be securely held to the cart (such as by straps, chains or other securing device). (2) The cart is on a firm, level surface. (3) The cart is not in an area where there is a reasonably foreseeable risk of being struck by vehicles, equipment, or materials (such as in a pathway for vehicles on a construction site).
