OSHA News for October 2017
Hello,
This month’s PowerPoint is robot safety.  I keep seeing people go into a robot area to get material that the robot dropped. The robot must be locked out if possible.
November is colder and slower month. It is a good time to work on those job hazard analysis. I am seeing over and over that having these reviewed before work helped everyone focus on the task for today.  One company that did 350 JHA’s had no lost days in 2016. None in 2017. Not bad for a place over 300 employees.
Quote of the month: “I need you to teach a certification class for employees in fall protection, lockout, confined space, and respirators. This will include a respirator fit test. You need to provide certificates for each module to the employees. And you need to drop your price 70%.”

OSHA News
1)           I regretfully announce the resignation of Callie Cordoba, CSC Training Manager, effective November 17, 2017. It is disappointing to lose such a talented and dedicated contributor to our team.  Our only consolation is that Callie is comfortable with her decision and considers it a step forward in her career. By Bob Lahey. I will miss working with Callie. She was not afraid to try to new classes and worked hard to coordinate the CSC training.

4)           OSHA investigating confined space death in a sewer in Streamwood IL.
5)           The California Occupational Safety and Health Standards Board (OSHSB) unanimously voted to adopt the Iron Workers International's (IW) comprehensive safety standard updates for reinforcing steel and post-tensioning activities. California is the first state-approved OSHA plan to work with the IW to reform existing safety standards. The IW Safety and Health Department has been working with the IW Department of Reinforcing Steel and industry stakeholders such as the Concrete Reinforcing Steel Institute, (CRSI), National Association of Reinforcing Steel Contractors (NARSC), Post-Tensioning Institute (PTI) and the Western Steel Council (WSC) to reform existing standards since 2010. 6)           OSHA still has not updated the total 2017 inspections.
7)           A memo issued Oct. 19 from Patrick J. Kapust, acting director of OSHA’s Directorate of Enforcement Programs, explains that the agency is now fully enforcing its construction silica standard. It says as of Oct. 23, 2017, the agency is fully enforcing "all appropriate provisions" of the standard.

This month’s PowerPoint is Safety and Health Training. I get asked for common training citations on audits. I revised an old ppt from ten years ago.  I use these programs for OSHA audits. There are many more, but these are the common ones.
The week off was a good break to relax and read. December and January are booked. There are only a few days left in February. I am see more training in General Industry than ever before.

1) Interesting OSHA interpretation on prescription inhalers.  “There is no need for the abnormal condition to include objective signs to be considered an injury or illness.”

2) OSHA delayed the deadline for crane operator certification for one year from November 10, 2017, to November 10, 2018. The extension and delay will allow OSHA to complete a related rulemaking to address issues with its existing Cranes and Derricks in Construction standard (29 CFR part 1926, subpart CC).

8) Indiana OSHA issues one of their largest fines ever. Loose clothing cited for machine hazards! Melissa Stephens, 44, died after an incident with a machine at the plant on Saturday, Oct. 21, according to a previous News and Tribune report. The preliminary cause of her death was ruled multiple blunt force trauma.

9) Secondary containers are missing any GHS labels in my audits. “NFPA Diamonds and HMIS can still be used. “Employers may continue to use rating systems such as National Fire Protection Association (NFPA) diamonds or HMIS requirements for workplace labels as long as they are consistent with the requirements of the Hazard Communication Standard and the employees have immediate access to the specific hazard information as discussed above. This month’s PowerPoint is combustible dust. I still audit places with inches of dust and not thinking much about it. They haven’t had the fire or explosion and think it will not happen there.

It was good to see people at the Conferences. I always learn from watching others.  January is the next round of the conferences.

OSHA is spending October writing up all those inspections they were told to do last month. Everyone is waiting for the new OSHA head, but no announcements were forthcoming. 

This is fire safety month. Check and see if the fire extinguishers are charged and readily available.

4) Builders Get 30-Day Break-In Period for Silica Rule

Construction companies will be able to ease into compliance with a new federal safety rule requiring limited exposure of workers to a silica dust that can cause cancer and other fatal diseases.

For 30 days after the rule becomes effective Sept. 23, the Occupational Safety and Health Administration only will “carefully evaluate” companies’ good faith efforts to meet the new requirements for airborne crystalline silica, Thomas Galassi, the agency’s acting deputy assistant secretary, wrote in a memo to regional administrators Sep. 20. OSHA will only issue citations if no effort is being made to meet the standard, he said.

The rule, issued in March 2016 after decades of debate, has already been delayed once by the Trump administration. It also is being challenged in court by employers who say the rule sets too strict of a standard. Arguments on that case, in the U.S. Court of Appeals District of Columbia Circuit, are set to begin Sept. 26.

6) Nevada Gov. Brian Sandoval has signed Assembly Bill 190 that requires the entertainment industry to complete two Occupational Safety and Health Administration (OSHA) safety courses through a certified instructor.

This month’s PowerPoint is Bridge Safety. Several standards apply, but not many look at the issues that come up in building bridges. I have had a chance to inspect many in the last three years.
30% worker workers are afraid to report a safety issue. This is troubling and seems high in my experiences. What works to break the barriers? Reward reporting of issues. I see many companies get issues brought up by asking the workers and managers.  Opportunities for Improvement, Find and Fix action cards, Safety reporting boards work. Suggestion boxes do not work. Top places get 50% suggestions. Average places 10%.

I will be teaching OSHA recordkeeping and Bloodborne at the Chicagoland Safety Health and Environmental Conference is being held September 18-22, 2017 at the Naperville campus of Northern Illinois University.  This once a year premier training event provides timely and expert training for OSHA/EPA compliance, general safety, industrial hygiene, environmental management and professional development.  Each year since 1988, hundreds of people attend the conference.  The 2016 conference drew over 400 people from 17 states and 89 Illinois communities.  Register NOW at the website www.chisafetyconf.org

1) OSHA revised the new online whistle blower form
The updated form, available in English and Spanish, prompts individuals through a series of questions, such as:
Have you suffered an “adverse action”?
When did you suffer the most-recent adverse action?
Why do you believe you suffered the adverse action(s)?
Each question leads users to another question, until the form is complete. OSHA said that one new feature of its reporting system is the addition of pop-up boxes to the complaint form with information about various agencies for individuals who respond that they engaged in protected activity that may be addressed by an agency other than OSHA.

2) The proposed organizational name change to the American Society of Safety Professionals passed by membership vote.  After verifying ballots, 4,918 votes were received out of 35,138 eligible for a return rate of 14%. 74% (3,651) of votes are in favor, 26% (1,267) opposed.

5)   Loren Sweatt was appointed as the new Deputy Assistant Secretary of Labor at the Occupational Safety and Health Administration(OSHA). For the past 15 years, she served in the U.S. House of Representatives as a Senior Policy Advisor on the Committee on Education and the Workforce, where she worked with OSHA and the Mine Safety and Health Administration (MSHA) on workplace safety issues.
Sweatt holds a BA in Political Science from Texas Christian University and an MBA from Marymount University.

This month’s PowerPoint is minor servicing exemption in the OSHA lockout standard.  It is machine guarding or lockout. Sticking your hands in a machine exposes you unexpected re-energization, hazards of gravity or it is cycling again. Top 5 issues that I see over and over.
1) No specific procedures to lockout a machine.
2) No tag on a lock to identify who locked it out.
3) Cleaning people in the machine. No lockout or machine guarding. Are the cleaners authorized employees?
4) No lockout audits for authorized employees.
5) No records of the lockout training.  Was it on the job? Class room?
There were 60,000 opioid deaths in 2016. Some were heroin, some were legal pain killers. I have started talking about impairment at work with the companies. Many can be on legal drugs and be impaired. Do you want an impaired person running equipment or machines? Morning stretches with a job brief can pick up this impairment. So, do you train the managers what to do?
I am seeing so many people taking fake OSHA 30 classes and getting certifications in safety that are not really recognized. The CSP and ASP are accredited by the American National Standards Institute, the primary source for internationally recognized standards in U.S. based professional practice. The certifications are accredited through the ANSI/ISO/IEC 17024 standards for personnel certification programs.
National accreditation has become the yardstick for acceptance of a certification by many federal, state, and local agencies. Accreditation standards cover fairness in testing, audited financial disclosure, independence in governance, validated examination content, non-discrimination of candidates, and many other criteria.
BCSP is accredited by the National Commission for Certifying Agencies. The CSP was the first certification in safety, health, environment, and ergonomics accredited by this national organization which evaluates peer-operated certifications.

1) OSHA lost Dorothy Dougherty — on a happier note — to retirement.  Dorothy had too many jobs to name in her 37 years at OSHA and MSHA, but I knew her best as Director of Standards and Guidance, and then as the career Deputy Assistant Secretary for the last several years.
2) The House Appropriations Committee released its FY 2018 Interior and Environment Appropriations budget bill today and it fully funds the Chemical Safety Board

4) The Occupational Safety and Health Administration will launch on Aug. 1, 2017, the Injury Tracking Application (ITA). The Web-based form allows employers to electronically submit required injury and illness data from their completed 2016 OSHA Form 300A. The application will be accessible from the ITA webpage.
Last month, OSHA published a notice of proposed rulemaking to extend the deadline for submitting 2016 Form 300A to Dec. 1, 2017, to allow affected entities sufficient time to familiarize themselves with the electronic reporting system, and to provide the new administration an opportunity to review the new electronic reporting requirements prior to their implementation.

Trimethylindium is an organometallic compound commonly used in the manufacture of semiconductors. Derek Lowe said contact with water or air at a temperature below 130 degrees can cause the compound to ignite.
