If  It Can Be Netted

10 year Year Repeat Violation
In the recent Active Oil Service, Inc. OSHA Review Commission Decision., the OSHA Solicitor of Labor had amended a confined space citation to be Repeat in the alternative based on a 1989 citation, and OSHRC changed the Willful $42K to a Repeat $20K based on the 1989 citation.  There is prior case law that the Commission does not have to follow OSHA’s 3 year Repeat policy. “The Commission has long held that the amount of time between violations does not affect whether a violation is repeated”.

  4. Not doing hoist and underhung crane inspections (ANSI B300.11/B30.16)
  5. Incompatible storage of acids and cyanides
  6. Standing on pallet on forklift (ANSI B56.1)
  7. Exceeding hoist capacity (ANSI B30.16)
  8. Forklift platform with no capacity, Back of platform not screened, or weight of platform not marked (ANSI B56.1)
  9. Homemade lifting devices not proof tested or have a designed capacity (ANSI B30.20) 
  10. No emergency stops for conveyors

Josh Moore of the Aurora Office recently drove by an unsafe condition at a church. The worker was using a rough terrain forklift and put a ladder on its platform. Since he was a volunteer, we didn’t have jurisdiction, but Josh stopped and explained the many hazards. 

Shopping for Safety

We found this homemade lifting device recently on one of our Saturday inspections. They altered a shopping cart and added chain slings to make an unsafe lifting device. Photo by Ken Korroll.  

Electrician Electrocuted

An electrician died in August in Belleville while installing a 277v fluorescent lighting ballast in a utility garage. This process has killed several journeymen electricians. OSHA would expect circuit breaker lockout devices and Class 0 gloves to be worn as a minimum method of protection. Any facility with these lights eventually will have a person that must change a blown ballast. A review of your lockout program, personal protective equipment, and electrical safe work practices should include this process to ensure another accident does not occur.  

Man survives 70 foot fall into River
A painter was on a temporary platform underneath the I 74 bridge in Peoria on July 30 when he flipped over a guard rail and plummeted into the Illinois River. The worker was rescued by two fishermen and taken to a hospital. The worker was trying to remove a stuck painting wand when it released sending him over the guardrails. 
Worker killed by plywood

In Champaign in July, a worker died of complications from injuries sustained when the plywood sheeting that was being lifted to a roof, slid off the carrier and struck him.
