This month were several hours working on projects for different associations. Everyone likes data that is specific to their sector. The ppt for the month will show some of that.

Tom was Instrumental in pushing Construction Safety in the Chicagoland area when everyone was focusing on industrial safety in the early 1990s. The CSC was the first place to push the 10 hour class and other training. Today most workers in the area have several classes in construction safety. The Midwest has less construction fatalities than most areas. Thanks Tom.

1. The Senate Committee on Health, Education, Labor, and Pensions (HELP) has voted to send President Trump’s nomination of David Keeling as Assistant Secretary of Labor for Occupational Safety and Health to the full Senate for confirmation.
2. OSHA Budget will be: $632.3 million — level funding compared to FY 2025, including support for programs such as the Voluntary Protection Programs and Susan Harwood Training Grants.
3. 1910.151(b) Adequate first aid supplies shall be readily available. Do you require a tourniquet to be in the first aid kit?
OSHA doesn't mandate specific tourniquet requirements but requires adequate first aid supplies based on workplace hazards, leading to the adoption of the ANSI/ISEA Z308.1 standard for tourniquets. The current ANSI standard requires any tourniquet included in a workplace first-aid kit to be at least 1.5 inches wide, effective on limbs from 7 to 33 inches in circumference, and use a ratchet or windlass for tightening.
4. Changes to long-standing OSHA training grant program
For fiscal year 2025, OSHA is awarding Targeted Topics Training Susan Harwood Grants to only three types of entities: OSHA On-Site Consultation Programs, OSHA State Plans, and OSHA Training Institute (OTI) Education Centers. This ensures appropriated funds are allocated efficiently and effectively by the end of the fiscal year, the agency says.
5. Fifth Circuit court of appeals ruled against Mar Jac Poultry in the horrible death of a worker who was killed by one of the most dangerous machines in that plant. This was the first of two deaths in that plant in a few years related to dangerous equipment. Here is my interview about the case. Bravo for OSHA for this win.

This Month's Powerpoint: Ethanol Plant Safety.  I made one in 2009 and updated to this year. Numerous ethanol plant explosions in the last 25 years. 
It was good to see the OSHA people at the Lockout training in Naperville and catch up with current events. 
I am running into odd issues for lockout. I got involved in a Safety Bypass Work Permit to replace a safety device. We are using a forming of machine guarding to eliminate exposure while we wait for the parts to come in.  
One company went with Mips ANSI Class 2 Helmets. 
MIPS, which stands for Multi-directional Impact Protection System, is a safety technology designed to reduce rotational forces that can be transmitted to the brain during angled impacts. It consists of a low-friction layer, often a thin plastic liner, placed inside a helmet between the padding and the helmet shell. When an impact occurs at an angle, this layer allows the helmet to slide a small amount (10-15 mm) relative to the head, redirecting and absorbing some of the rotational energy. This movement is intended to reduce the risk of concussions and more severe brain injuries.
What are the common NFPA 70E issues that you see for industrial locations?

Predictivesafety.com has fatigue alertness screens and monitors to tell if a work is too tired. Anyone have experience with this type of solution?
One of the largest insurance companies for worker comp said 2025 has been many injuries with mobile equipment and industry workers. Forklifts, pallet jack, moving carts etc. They are pushing forklifts to have safety devices such as red lights for side 2 Foot rule, Blue light front and back. Annual forklift operator training with how to secure loads. Annual certification review for powered pallet jacks. Conduct manual pallet jack training. 35 pound pull push on carts that have to be moved.
$40 million at stake and the GC young safety person responds in deposition.
Q Any OSHA certifications, OSHA 10 or anything?
A No, sir.
You are the boss of a company. You can't put your signature on the safety program that you paid a consultant to do and you do not know anything about the program. Then there is boss's admission.

July was much project work for clients. 
This Month's Powerpoint: Wind Tower. I had made one in 2008 and updated to this year.. 
My Floor hold case settled. The $5 million dollar floor hole. Yet another successful win. 35+ years without a loss. 
1926.501(b)(4)(ii)Each employee on a walking/working surface shall be protected from tripping in or stepping into or through holes (including skylights) by covers.
A $5,000,000 settlement was secured, along with a waiver of $800,000 in workers’ compensation benefits, for a worker who sustained a serious shoulder injury after a mobile scaffold fell into an unprotected floor hole on a jobsite. The injury occurred while the worker was completing punch list tasks.
The investigation revealed that the general contractor exercised site-wide control and bore responsibility for coordinating work by subcontractors. After reviewing over 40,000 documents, it was proven that the general contractor failed to provide a safe working environment, ultimately leading to the incident. The hole was covered up after with a cone which does not meet the standard. 
Imagine reading 40,000 documents. The joy of being an expert witness.
The $20 million dollar Toeboard. 
If the manufacturer requires toeboards, the competent person should follow their guidelines and put the $10 toeboard up.
I spent two days in July in discussion with the partner and his staff in getting the information for the partner to present the demand letter. ‘They are asking for $20 million. Names changed.

Date of Injury: July 22, 2023 
Claim: Negligence – Personal Injury (Severe Injury from Falling Object) 
Demand Amount: $20,000,000
FACTUAL BACKGROUND
On July 22, 2023, Mr. Rogers was working in a designated area on the third floor of the building under construction when a heavy pipe rolled off an improperly equipped scaffold on a floor above, striking him. The scaffold, used for material handling, lacked essential safety measures, specifically a toeboard, which would have prevented the pipe from falling.
Axis Construction, as the controlling employer, permitted the use of this unsafe scaffold and allowed work to proceed below it without adequate protection. No proper hazard assessment or pre-task planning was conducted for work involving materials on elevated scaffolds. No inspection was performed by a competent person to ensure scaffold safety. These omissions directly violated Axis Construction’s fundamental safety obligations and several applicable OSHA regulations, including:
29 CFR 1926.451(h)(1): Requires protection from falling objects on scaffolds through the use of toeboards, screens, or guardrail systems.
29 CFR 1926.451(h)(2): Mandates toeboards along all open sides and ends of platforms 10 feet or more above a lower level.
29 CFR 1926.451(h)(2)(v): Requires paneling or screening extending from the toeboard to the top of the guardrail when materials are stacked higher than the toeboard.

My fourth tunneling cofferdam safety class this year. 
Shouldn't every worker in a tunnel have some kind of tunnel / cofferdam safety class with a test?
The Free Lockout webinar through NIU had 515 attend. The Free lockoput class August 15 is full at 40 people in Naperville. 
We had a record 78 people get certified this month. Most were CSP beating the August 1 deadline for CSP10. August 1, 2025 the score to pass CSP11 was raised.

1. Occupational Safety and Health Administration: OSHA is expanding its Voluntary Protection Programs to meet businesses where they are on their safety journey to help develop strong safety programs and lower injury rates, allowing them to undergo regular self-evaluations and avoid routine inspections. OSHA is increasing its efforts to support voluntary compliance through its On-Site Consultation Program, which offers no-cost and confidential safety and health services to small and medium-sized businesses.

OSHA announced penalty reductions in July 2025 for small businesses and employers with good safety records, expanding eligibility for penalty cuts and introducing new incentives for prompt hazard correction. Employers with 25 or fewer employees now qualify for a 70% penalty reduction, up from the previous 10-employee limit. An additional 15% reduction is available for fast hazard abatement, and a 20% reduction is offered for employers with no history of serious violations.

4. Under the Department of Labor’s FY 2026 budget proposal, the White House is seeking to cut roughly $50 million from OSHA’s budget and reduce the agency’s full-time workforce by 223 positions — from 1,810 to 1,587.
OSHA had a $632.3 million budget in FY 2025. The proposed $582.4 million budget would represent about a 7.9% cut.
The agency would be expected to make up part of the savings by spending around $23.7 million less on enforcement than the $243 million spent in FY 2025, focusing more on compliance assistance.
The Department of Labor also plans to eliminate $12.8 million for the Susan Harwood Training Grant program, claiming the grants are “wasteful and unnecessary” due to limited evidence of success. The agency says it has other compliance assistance programs and tools that are more effective than the Harwood Grants.

Hello,
June was a hard month of crawling in a gravel steam tunnel, doing audits in the heat and teaching second and third shifts. 
The Tornado Safety Plan for warehouses is moving along. See OSHA #3.
See OSHA #5. Under this new proposal, OSHA would not cite employers for general duty  hazards that are:
1.	Inherent and unavoidable in certain professional or performance-based occupations, (seaworld)
2.	Integral to the core function of the work, and
3.	Cannot be eliminated without fundamentally changing the nature of the job,
provided the employer has made reasonable efforts to reduce risk.

The OSHA data penalties were finally opened. I posted the last 200 high penalty cases. 
My Construction Manager case settled. The case involved a worker who allegedly got hurt trying to stop a light interior panel wall from toppling. There was no evidence it toppled at all other than the worker tore the rotator cuff. Lack of good accident investigation meant everyone got sued. The CM was not there the day of the injury, the owner was. The owner settled earlier. 
We had 32 people get certified this month. More and more ads want BCSP certification in construction.

5. OSHA proposes to change enforcement of the General Duty Clause. . OSHA now says the clause doesn't "authorize OSHA to prohibit, restrict, or penalize inherently risky activities that are intrinsic to professional, athletic, or entertainment occupations." If adopted, the change would align OSHA policy with then DC Circuit Judge Brett Kavanaugh's dissent in the 2014 Seaworld decision about the death of a trainer killed by a killer whale.

May was an odd month. One week up at 4 am to teach early every day. Next week, all night/second shift classes.
We had a record 37 people get certified this month. More and more ads want BCSP certification in construction.

Workplace Extreme Temperature Safety Act (H.B. 3762) would codify a rule requiring employers to develop a temperature-related injury and illness prevention plan. The rule would include provisions for retaliation, violations, penalties and enforcement.
The plans would be required to incorporate procedures that include:
Regular monitoring of workers for excessive exposure to heat and cold.
Providing potable water that’s immediately available and in the vicinity of workers impacted by heat.
Access to shade, cool-down areas or climate-controlled spaces, along with paid rest breaks, for workers impacted by heat.
Warm, noncaffeinated beverages for workers impacted by cold, along with paid rest breaks and access to warming stations sheltered from wind and precipitation.
Limits on how long employees can be exposed to heat or cold during a workday.

This Month's Powerpoint: Farm Safety. Data suggests that worker deaths are more frequent on family farms than at grain milling and storage facilities, primarily due to the higher prevalence of grain entrapment incidents on farms. Over 70% of grain entrapments occur on small or family farms, which are often exempt from OSHA grain-handling regulations, compared to commercial facilities. In 2015, 82% of reported grain entrapment cases nationwide occurred on farms exempt from OSHA compliance, while only 4% were at commercial grain facilities. Since 1966, over 900 grain engulfment cases have been reported, with 62% resulting in death, and 52% of entrapments with known locations occurred on farms compared to 48% at commercial facilities.
My skylight case settled. The Roofer should have put guardrails or covers on them when doing roofing work.  The controlling employer must inspect the site and require protection.
Tales from the front:. The state plan OSHA compliance officer went to prove the panel was live 480 volts. The company is Fortune 1000. The safety director took a photo of the CSHO adjacent to the live panel without arc flash PPE.
Check your body for ticks if in the woods. Several people are finding ticks on them.

1. Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 15.5% of all traffic fatalities and 3.4% of all injuries in 2023. A factor that directly influences motorcycle fatality trends is helmet use.
Fatalities among motorcycle riders and passengers increased 1% from 2022 to 2023, while the rate per 100 million vehicle miles travel increased by 19%. The fatality rate increase in 2023 is a result of a 15% decrease in miles driven (see additional details below). Over the last 10 years, deaths have increased 38%, while death rates have increased 36%. The number of motorcycle fatalities now stands at 6,335 and the rate is 31.39 per 100 million vehicle miles.

April ends the period of four months at full speed. Now it will slow down. 
It was good to see Paul Satti teach in the OSHA 502. He is a manager now at Fermilab. 
OSHA offered buyouts to managers and National Office. I figure 100 people will take the buyouts. I will know next month. 
Lee Martin left as Director of Whistleblower. 
Heat Injury and Illness Prevention: OSHA announced a public hearing to be held on June 16 regarding the proposed rulemaking for heat injury and illness prevention (announced on April 16, 2025) 
OSHA proposed $262,174 in penalties.to roofer in WI.  The agency has inspected Almanza work sites 10 times and cited the contractor for similar violations.

March was Confined Space Month. I went in 20 spaces this month. All of a sudden Alternate Procedures are hot. 
I got word that long time employee Keith Daly took the buyout.  OSHA will consolidate some offices and cut management staffs next in the round of budget trimming.

I conducted training at a client’s site in March, where many workers speak Spanish. 
Claudia had translated the slides into both English and Spanish. 
I first covered the English text, and then she communicated the yellow text for the Spanish-speaking group. 
The session went exceptionally well.
I like the dual language on one slide. 
I have been pushing proof of training for competent person. I think this is a weak area for many companies.

February was a whirlwind for OSHA. The probationary employees are gone. The Reduction in Force came out this week. This usually means management cuts.
I got word that long time employee Bonnie Knisch in Fairview will retire. Gary Weil of Chicago North will retire this year also. Howie Eberts, the Cleveland AD will retire. 
OSHA had to write 5 things they did this week to OPM via the manager. It was easy since OSHA compliance officers have many tasks on any given week.

OSHA News for Jan 2025
Hello,
January was a month of legal and certification training. I spent a lovely cold week with the AGC teaching ASP and SMS prep classes. I had two depositions, one was premise liability where falling stock hit a customer, and the other was 8 lawyer deposition, where a worker was crippled when falling out of an aerial lift without a harness.
Many directives are coming for the new team. Most won’t affect OSHA.
OSHA and other agencies to return to the office full time.
• Scott Ketcham will serve as deputy assistant secretary for OSHA, the US Department of Labor
• Erin Gilmore succeeds Ketcham as director of the Directorate of Enforcement Programs, taking on the role in an acting capacity. Most recently, she had served as the directorate’s deputy director.
 
Effective Jan. 15, 2025, the serious penalty max will be $16,550 per violation (up from $16,131 in 2024). Repeat and Willful get similar adjustments ($165,514 up from $161,323).

Historic $5.7M Settlement for Union Bricklayer After Ladder Fall
A 45-year-old union journeyman bricklayer suffered a devastating fall while installing anchor bolts on a 14-foot masonry wall at O’Hare Airport on December 31, 2018. Initially assisted by a spotter in the morning, he was later instructed to work alone without fall protection or ladder stability equipment. The ladder slipped, causing him to fall 10 feet and sustain severe injuries, including a torn labrum, two surgeries, a total hip replacement, and future revisions due to his young age.
Despite the defendants attempting to deflect blame, the worker’s injuries and projected future wage losses of $800,000 to $1.6 million solidified the case. The settlement included $3.9 million from the general contractor and a historic $1.8 million from the safety subcontractor—the largest safety subcontractor settlement in history.
This case, in which I served as the expert witness, is making waves throughout the safety community.

December was busy nonstop until the 22nd. I spent the last 2 weeks working on the certification test guides trying to explain the answers.
I trained 3761 people, which is a 10-year high. The goal is 2000, but training was in demand.

1) A Naive Attorney expects the Area Director to testify in a civil trial.
I got 50+ subpoenas during my time in OSHA and all were quashed.
The AD is expected to testify to his education, training and experience, along with his job duties and responsibilities as an area director for OSHA. He is also expected to testify about his investigation of the June xxxx accident, including the bases for any OSHA violations and resulting citations and fines that were issued to AAAAA and any opinions developed as a result of his investigation including, but not limited to, his conclusion that AAAAA violated OSHA regulations as set forth in OSHA’s Citation and Notification of Penalty issued on XXXXX. He is also expected to testify consistent with and in furtherance of the subject matters and opinions that he discusses during his deposition, if taken.
